I was interested in joining "Knuckle Up" because they offered the type of gym I needed. Having a conditional offer of employment for a federal job, I could not agree to a contract without an amendment saying that I would not be billed if I was offered a job. After much deliberation Store Manager XXX and Area Sales Manager XXXX drafted an amendment saying that I could "freeze" my account if I was hired, when I presented them a copy of my orders. Two verbal statements were given to me from "XX" saying that since I could not get out of the contract with the normal relocation procedure, I WOULD NOT BE BILLED if I presented them with a copy of my orders assigning me away from Atlanta. I was happy to get this what I thought resolved and signed a one year contract with this amendment on 3-26-07.
Well, I was called for duty after a few months of enjoying the Gym, and I tried to cancel or freeze by letter on 8/15/07. I am now in the middle of 9 months of training that keeps me out of Atlanta, but unable to get a new permanent address. I will never be in Atlanta again. "Knuckle up" continued to bill me, and I was forced to protest the charges on my credit card (successfully). I have repeatedly explained my situation to billing, and "XX", but noone who has the power to change my status has ever called me back. I have made 15 phone calls, faxed a dozen pages of documents that verify my status, and stopped by the gym to show them my gov't ID, but never has anyone called me back or helped me, other than their billing company ASF, who offered to help if I made a down payment on the monthly payments I they clain I owe. The contract I signed NOWHERE describe "freezing" keeping on billing me like I have had done to me. The amendment is for the exact situation I am in, and they now refuse to honor it.
I have been out of town of 13 weeks and come back to a stack of invoices and late fees of over $300 ($59/mo + $29 late fees +$20 billing fee /mo?)
Be careful, I thought I was!

Yes, I know
Freeze to the rest of the free world means you are not billed until you can use the gym again. Being billed forever without using gym is not in our agreement

First of all, to "freeze" your membership is not the same as cancelling it. It simply stalls the automatic payments during the time in which it is frozen. It does NOT absolve you of the rest of your contract obligation.
Second, why did you go by a "verbal agreement" when they drafted an amendment to your contract? Why didn't you insist that said "verbal agreement" be put in writing in the amendment?
Third, nearly ALL gyms require that you provide proof of address when cancelling due to moving X number of miles away from the gym. You could not provide any type of address. Therefore, how is the gym supposed to know that you were TRULY moving and not just trying to get out of your contract via unsavory means?
