Mitchell Kay Law Offices sent an authentic looking bill to our daughter, who is away in college, stating that she owed $453.32 but would settle for a lump sum of $271.99 as a pay off on this account (411993216-B). Our daughter does not even go through T-Mobile. She is with another cellular phone company.

The notice also goes on to say (which would intimidate a person reading this), "Unless you notify this office within 30 days ofter receiving this notice that you dispute the validity of this debt or any portion threof, this office will assume this debt is valid." It further states,"If you notify this office in writing within 30 days from receiving this notice, this office will: Obtain verification of the debt or obtain a copy of a judgment and mail you a copy of such judgment or verification."

On one side it says to return bottom portion with payment, while on the back it says "This letter is for informational purposes only. This letter is not a demand for payment or an attempt to collect, assess or recover a claim against you before the commencement of your case."

It's kind of like, what the heck?? Go figure.

On the back of the letter where it says that this letter is for informational purposes only and is not a demand for payment etc etc, Above that statement it says "The following applies to any recepient of this letter who is entitled to the protections offered by 11 U.S.C. 362 of the United States bankruptcy code." That means that for those who have filed bankrupcty this is just an informational letter. If you file bankruptcy, you are protected by the law and collection agencies cannot harrass you to pay a delinquent debt. This part about the letter being for informational purposes does not pertain to you if you have not filed bankruptcy.

Have you tried contacting T-Mobile to check on the validity of this?

It honestly sounds like a phishing scam. It could be that or possibly identity theft.

I would have your daughter call and see what she can find out before you get too upset:)
