This 'attorney's office' wrote a letter to me with my full name stating that their law firm had been hired to represent the Lee County Clerk of Courts (which is the county I lived in at the time). They further stated in the letter that I was being held responsible for an unpaid traffic citation in the amount of $36.10. They warned that my drivers license would soon be suspended as well as possible prison time for me. I worry about other people believing this because they actually had my driver's license number. They asked for me to send a check or money order to the address (which was in Texas). I immediately called the number knowing this was a scam. My wife was out of town on the date they had given as my 'ticketing' date in a completely different county.

Well, needless to say, after telling 'Ivan' the operator, that his scam was up, he was totally unprofessional and never even pretended to act like this was real. He knew he had sent the letter to the wrong guy. It was not going to work for me. I said some rather unnice things and he was laughing saying, "Sir you are wasting your time, I have a lollipop in my mouth". When I threatened him with legal action, he said, "You are wasting your time that doesn't work."
Tomorrow I am going to the Lee County Courthouse and reporting this so -called law firm. Be careful!

You cannot be sent to prison for an unpaid debt, even if it is a traffic ticket. There is no such thing as a "debtor's prison," at least not in the United States.

Even if you did owe this to the government, it is most likely a very very very old ticket that got expunged. This is especially true if it is only for such a tiny amount as you mention.

It is also illegal to threaten a debtor with prison, no matter how big the amount is.

Both Bud Hibbs and Clark Howard have "drop dead" letters that you can send to such institutions, along with instructions on how to send them (certified mail plus certified return post card) and what to do afterwards if they still harass you.

What petty-minded twirps, eh? They must be getting extremely desparate for money to collect if they are threatening you with prison over thirty six dollars and some change. I've seen some horror stories of bottom feeders such as these digging up debts as old as twenty-five years! How pathetic.

They have been harassing my husband, too

For at least four years, they have been either sending letters to my husband or calling him over some issue that occured in 1994 for which he owes around $300. They said he could be driving with a suspended license, which I found laughable because he had no driver's license in over 30 years.

When he finally decided to get one again last year, this issue never came up in their computer system at the Florida DMV office. One other issue did, when he was ticketed in 2003 for not wearing his seat belt while riding with a friend, who got pulled over.

They are more full of poop than a doggie kennel. According to the web site by Bud Hibbs, they used to be a reputable firm but now they are a laughing stock. If the DMV has nothing on their record, you have zilch to worry about. They are "renegade debt collectors" as defined on the Clark Howard radio show and there is nothing they can do to you.
