The original CC was charged off in May 2005. Love Beal & Nixon is suing me for Capital One for 880.14 plus 466.82 for interest, 291.00 for court costs and 200.00 in attorney fees. They said that would take payment plan, but would still have to get a summary judgement against me on August 25, 2008 unless I pay them 1250.00 by September 5th. Can they do this?
