I personally met with Mr. Arthur of McKenzie Scott (McKS) on January 17, 21, and 24, and had a telephone meeting with him on the 22nd. During those meetings and discussions, it was explained that McKS provided Career Transition Services in the tangible forms of: 1. Preparation of two resumes (an electronic and two formatted versions of a general, one called a quick response). 2. Electronic and USPS distribution of said resumes to recruiters, targeted companies, and venture capitalists. 3. Access to McKS proprietary website and job board listings. 4. A job search marketing plan.

At each appointment, Mr. made it clear that all money was 100% refundable if I was not satisfied at any point in time, up until the point where I was to take possession of the hardcopy materials (resumes and marketing plan). On our meeting on the 24th, the cost structure was explained in a written agreement. At that time, Mr. also encouraged me to include an additional $1,000 option, the preparation of an interview resume, that it was necessary to request the service at that time, and that it also would be refundable should I choose not to take possession of the document. With the emphasized McKS Money Back Guarantee, I made a $2,000 deposit against the $6,500 services under the instruction by Mr. that it was all 100% refundable if I was dissatisfied at any time, up until I took possession of any hardcopy materials. Within seven (7) days of the agreement date of January 24th, I was to make final payment of the remaining $4,500 and complete additional questionnaires at their web site. Also, an all day meeting was set for February 12 to visit additional McKS personnel at their location in Roseland, NJ.

Within that seven day period, I learned that the McKS resume template was not desirable amongst my network of venture capitalists, HR personnel, and hiring decision managers. The produced set of resumes was the cornerstone of the McKS marketing campaign and I now had significant doubts about the McKS strategy and, subsequently, the value of any relationship with McKS. I did not make payment of the remaining $4,500 before the January 31st deadline required to continue. I verbally expressed this to Mr. Farley, a McKS contact at the Roseland, NJ location. At that time, Mr. began to engage me with high pressure sales tactics, delayed and extended payment deadlines, and had arranged for me to pay the balance with a credit card (a policy that was not previously made available), as I felt more comfortable paying under the protection provided by credit card transactions. I expressed to Mr. my dissatisfaction with the McKS resume model, that I had no intention of taking possession of their materials, and that I saw no need to waste any further time on either of our behalf. At that time, Mr. did NOT explain any policy of the need for me to make FULL payment AND attend the all day session in Roseland AND ONLY THEN reject all materials entirely in order to invoke the McKS Money Back Guarantee. Clearly, this would have been the appropriate and ethical time to note such a policy to me.

After the non-payment of the remaining balance of $4,500 and expressing my dissatisfaction of the McKS marketing program, I subsequently sent an electronic message on February 11th to Mr., with copy to Mr. Farley, making clear of my intention to not progress with McKS nor attend an all day meeting in NJ.

About one week later, I received a letter dated February 13th from McKS, stating that they had no intention of refunding the original $2,000 deposit made to my NFCU Visa Platinum credit card. In the letter it then describes how the McKS Money Back Guarantee is only valid where all money is paid and meetings kept as scheduled, and that all materials produced are unsatisfactory once presented. This policy was, and is contrary to all statements made by Mr. . It also is contrary to the additional promise he made regarding the optional $1,000 interview resume being rejectable in part, outside of the other presented materials, and refundable. Further, in that same letter, McKS notes that within twelve (12) months, I could continue and fulfill the program should I make the final payment, however, the Money Back Guarantee would no longer be available to me.

Such stringent refund policy could have been made or referenced in any of their forwarded booklets, containing some 60, 36, and 224 pages each. Mr. never delineated such a policy when noting a Money Back Guarantee in person of over the telephone and certainly did not warn me of any non-refundability when it would have been most appropriate.

My first recourse was to dispute the deposit/retainer with my credit card company. Simultaneously, I reached out to several web sites and local news media sources to increase the exposure of my experience. The interaction between my credit card company and McKS is unavailable to me. Also, I am uncertain as to how much influence my efforts to publicize my experience made with McKS. I can report, thankfully, that the $2,000 charge has been reversed and the dispute is closed.

Arthur called me and agreed with my statement noted above with the exception of how the Money Back Guarantee had been detailed by the materials and contract. Arthur is a polished professional and truly warm individual. He wished me well in my new position (found outside of the McKS program) and I in turn returned the regards.

MY RECOMMENDATION TO PROSPECTIVE CLIENTS OF McKS :

One should be 100% comfortable paying for their services all up front and in one payment and before any materials or database access is granted BEFORE making the commitment to pursue a relationship with McKS for career transition services. Due to the rigorous and severely confining Money Back Guarantee, a prospective McKS client is unable to ease into the professional relationship. It should be approached as an all or nothing proposition with no intention of cancellation as there is a very limited window open to their clients for withdrawing.
