I am a 56 year old school teacher who lives alone. I have been renting 3-5 dvds every weekend from Movie Gallery for years. When asked if I wanted the 25 cent 'damage protection' the clerk would say each time 'in case you damage it'. I would refuse it each time because well, I have no children and am never rough with the dvds. In other words I am the last person to damage one. Anyway, a DVD I had rented kept sticking but would start back up and I was finally able to get through it. I dropped it in the box on my way to work the next morning. Had it in my possession less than 12 hours. Today when I went to get my weekend stack of dvds I was told I owed $21.53 because the last dvd I returned was 'badly scratched'. No matter what I said the clerk kept saying 'well since you didn't take out damage protection you have to pay for the damage.' I kept telling her I didn't damage it, that it was already scratched when I got it. Her answer was I should have called.

What a scam! If you don't pay that extra quarter you are responsible for damage to any dvd you rent even if you did not damage it. Because you can't prove you didn't damage it. Also no dvd was presented to confirm their charge and no manager was available.

Needless to say I paid the $21.53 and told her they had just lost my business. It was only then that she offered to call her manager. I told her she had lost my business. From there I went to Block Buster and rented my weekend stack of dvds.

This goes for anybody: if you receive a scratched or otherwise defective DVD or game, the best thing you can do is tell the manager on duty. Simply returning a movie or game that is damaged without informing anybody (and I hate to say this) may as well be a guilty plea. Obviously each situation is handled case-by-case, but not saying anything isn't going to help at all.

I'm an employee. They tried to charge you the amount that is indicated in the computer as the "new" price, however if someone does not return a movie they are charged the used price which is usually $14.99 or less. This sounds like a manager who wants to get their numbers up. If playguard isn't to protect you in these situations then what's it for? A better suggestion would be to throw a quarter per movie you rent in a jar and if one is ever damaged, just pay for it. Employees are not told about any rules or anything concerning "damage protection", they're just threatened with termination if they don't convince enough people to get it.
