According to our rental agreement contract at our apartment complex, we are required to pay monthly utility expenses in addition to rent for their "utility management and billing company" called NATIONAL WATER AND POWER(NW&P).

Here are the problems noted with this arrangement:

1) We rarely get a bill from the apartment complex or National Water & Power. What we do get are notices from our apartment management, which are posted on our apartment door a "Notice of Default," falsely claiming that we are in violation of our rental contract and could be evicted.

2) The fees charged for services provided are monthly at varied rates, which is increasing every month. Please note: There has been no change in tenant occupany.

3) When the apartment complex was contacted to discuss the notice of default, I explained that my rent was paid which included $43 for utility charges. The notice was for $8, which now brings my utility charges to $51 a month FOR 2 PEOPLE. I asked why the increase, I was told that I'm using more hot water. It is apparent they are unable to explain the billing, and do not care to explain. This is the third time I have had to talk to them about these bills, and I'm not the only victim in the complex.

4) Conflict of interest -- It appears that in my case, one of the companies who has a invested interest in National Water & Power, is United Dominion Realty and Trust(UDRT). UDRT is the property owner of my apartment complex. INTERESTING!! How about one of the serving board members for NW&P was a CEO for South West Property Trust, which was acquired by United Dominion Realty Trust. IS THIS LEGAL?

Since this is not a regulated company, what rights does the consumer have? We are forced to use these services, and help the investors make money without any say so. THIS IS DEFINITELY GOUGING THE CONSUMER, FOR THEIR BENEFIT!

Power in Numbers, Fight Back!

You do not have to listen to "DOUBLE TALK" from NW&P. There are many victims of this "SCAM" in many cities. A money making scam for Property Management Companies to steal from residents with no rhyme or reason as the fees are not metered or a flat rate. In my complex, some residents pay while others do not. Everyone pays a different rate, even for the same unit with the same amount in the household. Then a so called processing fee. You pay for them to rip you off! All they are is a billing company. With a phony name. Report this to your local television station that has a consumer HOTLINE. Also report this to Your town's Board Of Supervisiors, then to Fair Housing. Last but not least.....Contact an attorney and get all of your Apt's residents together and file a "Class Action Suit". You can fight back! This has to be stopped!

National Water & Power (NW&P) would appreciate the opportunity to discuss your concerns with you. But in the event you do not want to discuss these issues further, we will briefly address them here:

1) Regarding receipt of bills from National Water & Power, it is National Water & Power's general practice to bill the residents at each apartment community on a monthly basis. If you have concerns that you are not receiving a bill periodically, please call NW&P's resident services team at the phone number below to further discuss and resolve. With respect to the property owner notifying its residents who have not submitted a utility payment that they are in default, NW&P cannot respond to these practices as we are generally not involved with this process.

2) Related to varying rates, National Water & Power bills residents for utilities at each apartment community based on a specific billing methodology approved in advance by the property owner. There are several billing methodologies that may have been chosen for use, including billing by number of occupants, or by square footage, or by using a combination of these factors. Each apartment community is assigned ONE billing methodology by which all resident billing amounts are calculated each month. In other words, the charges on the bills we send to residents at each apartment community are based on that community's owner approved specific methodology. Note that bill amounts may increase (even when occupancy does not) based on changes in rates imposed by the local utility company.

3) With respect to the explanations provided relating to a potential increase in your usage, it is difficult to assess your specific situation without looking more specifically at your account and, again, we would encourage you to phone the National Water & Power Resident care team.

4) As to your comments related to conflicts of interest, it is not uncommon to have various experts in a business' industry involved as a board member or advisor to a corporation. It is common practice in several industries. It is also common for a privately held company like National Water & Power to have various strategic and venture isinvestors to invest capital in the business as it matures. National Water & Power operates its business in a lawful and ethical manner and is very cognizant of any conflict of interest issues.
