I inquired about an interest only loan with Nations Choice Mortgage on 4-11-06. I found them on Bankrate.com. They were listed with very low interest rates and low fees. I guess I should have know right there and then it was too good to be true.
The loan officer Linda Schrader informed me that the loan application fee will only cost me $350. Linda knew I was shopping around for other loans. She told me that no lender should ask for any fees other than the appraisal fee. She claimed the $350 application fee will be used for the appraisal fee so there was really no application fee. Believing it would only cost me $350 I applied for a loan.
On 5-1-06 I signed the good faith estimate and the loan financing agreement. Linda told me I can be approved for a rate of 5.75%. Other lenders told me it was impossible to secure this rate but I trusted Linda. Linda then changed the rate they can offer to 5.87% and then finally to 6.125%. Other lenders again told me it was impossible to secure a loan for 6.125% and quoted me 6.25%.
I received a lock in rate confirmation for 6.125% with a 1% prepay on 5-5-06. After a few days Linda told me that the underwriter will not approve the loan unless we switch to stated income. She said the rate will now be 6.25% with stated income.
I emailed Linda on 5-9-06 requesting for a 100% financing loan with out the 1% prepay. I was never told there would be a prepay penalty. I didn't receive a response so I called her the following day and she told me the rate for 100% financing will be ridiculously high.
At this point I decided to finally apply for a loan with another broker. My real estate agent was very suspicious of NCM because they could not produce a loan approval from a bank. They would only send their approval on their letterhead. On 5-11-06 I received an approval for 100% financing from Chase Manhattan from the local broker.
Linda then informs me that they have problems with gaps in my employment history. On 5-24-06 I called Linda to inform her that I have decided to use another broker to secure my loan.
On 5-25-06 Linda called and told me I have to pay a 1% application fee because of the loan financing agreement I signed. On 5-25-06 Greg Goetz the collections manager called me on my cell phone and tried to coerce me into completing the loan application and promised to have me approved for 100% financing. Greg is not a loan officer but he was promising me he can get a loan approved. When I refused. He then asked me to pay $3300 for the loan application. I asked him to itemize what the $3300 was for. He didn't know. In the same conversation he lowered his application fee demands from $2500 to $2200 and finally to $2000. All sums for which he could not itemize any thing except lawyer and title fees. I informed him that the loan was never secured through them so there can't be any title or lawyer fees. He was very aggressive in trying to get payment and told me it would cost me $2000 just to go to court so I might as well just pay them.
On 5-30-06 I received a letter via Fedex from Nations Choice Mortgage dated 5-25-06. It states that they have only collected $350 of the $5032 non refundable application fee. They claim the Financing Agreement I signed authorized them to automatically deduct the 1% fee. Luckily I put a hold on my account after I found other fraud complaints on this website. I also checked with the Better Business Bureau.
The Better Business Bureau of Arizona reports that the most common complaint against Nations Choice Mortgage is over the rates and cancellation fees. Nations Choice Mortgage has responded to the Bureau stating that recent changes were made to its contract in order to reduce the cause of confusion. Clearly this is not the case and Nations Choice Mortgage continues to try and deceive unsuspecting applicants. Their closing costs estimate on the GFE is for $1495 yet their undisclosed application fee is 1%.
I consulted with the UCLA Law School and they informed me that I was a victim of consumer fraud and maybe even predatory lending. Apparently California is a favorite target for these type of companies because of the expensive real state market here and lax state predatory lending laws.
They also pointed out that it's illegal for companies doing business by phone in the U.S. to promise a loan and ask you to pay for it before they deliver. Requiring advance fees for loans is also illegal even if they call it an application fee. Lastly misrepresenting the terms of the agreements and fees is definitely considered fraud. Mortgage Brokers are required by law to disclose all fees.
I was told to file a complaint with the California Department of Corporations, www.corp.ca.gov against NCM and hopefully have their CA Broker license revoked.
Filling a complaint with the BBB is pretty much useless. They consider NCM in good standing because they try to settle 100% of the complaints against them. As far the BBB is concerned NCM asking for $2000 instead of the initial $5032 they tried to scam from me is an act of resolving the complaint. What a joke. No wonder NCM is still is business and a member of the Arizona BBB.
Learn from my mistake do not do business with this company. They just want your hard earned money just for filling out an application with them. They claim they have earned it. Check out this very pathetic attempt via email to get me to pay them:

Regarding your situation, YOU requested your loan to be locked. You expected me to deliver EXACTLY what you applied for. I have and per the SIGNED LOAN FINANCING AGREEMENT I have a right, by the State of
California, to cover the cost I have incurred in processing your loan.
I don't expect you show up at the hospital or a patients home, work for 8 hours, then say "MY TIME AND MY EFFORT IS FREE, YOU OWE MY NOTHING."
That is what you have done to us, that is the exact reason that if I can do everything I said I can do in my contact, I do have a right to cover my costs in your loan process.
As for BBB, if I can do EXACTLY what I can do what we signed the contract at, why should I get a black eye. If your saying that I did not provide you what I said I would, I will not ask for reimbursement of costs.
Linda, attempted multiple times to contact you and you did not return the favor until yesterday. We have done EVERYTHING WE SAID WE WOULD DO.
You can talk to Greg about resolution.
From reading other complaints on this website I'm very lucky I never secured my loan through NCM. I probably would have fallen out of escrow.
Guess how much I ended up paying the local broker for securing my loan? 0, nada. I found out that a legit broker receives all his fees from the lender. The appraisal fee was paid for from escrow. I didn't pay a single dollar to the broker.

Nation's Choice Mortgage Joe & Richard Garza of Nation's Choice Mortgage were true to their words!
At first, I read the reports on this website and was very reluctant to do business. After talking with Joe and Richard Garza multiple times, I decided to refinance with Nation's Choice mortgage. Their rates were more competitve then anywhere else.
Joe and Richard Garza were true to their words throughout the entire transaction. The refinance closed on time and they were honest with pricing and all aspects of the refinance. I would definately trust these guys to refinance again and would recommend them to any of my friends!

I agree with you that it would be nice to know. I know you know a lot more about these issues and we make it our business to constantly get new information.
In this ever tightening market, with lenders getting more and more 'dubious' about their advertising, I have decided to 'call them on the carpet' .
For every borrower i have, i go to the local banks websites and imput their basic ltv info -and get a 'best case ' scenerio of rate and closing costs. I get 3 estimates from the major players in my area. They are usually almost identical , showing my client that most direct lenders in general will offer basically the same terms as the other.
I print it out and take it with me to meet my clients to show them without a doubt i am getting them a better deal. It saves a lot of rate shopping.
The reason i bring this up is under 'perfect' conditions, one credit union right now is selling a 3/1 arm at 6.25 with normal closing costs.
Dont know about an 80 20 product I/O though.

I was wondering about that too.
On 5/25/06 my A lender was at .947% rebate on a 3/1 I/O ARM, Stated/Verified, so pretty close, probably could have received a little extra with a concession. No prepayment penalty.
On the 2nd, you received a great deal and so did the fish on the rebate. That is a hell of a combination for both parties on a stated 2nd TD loan.
Kind of curious though.Annaliza started this post with a certain amount of naivete, it seems like she actually knows a lot more than she is letting on

One last question, when did big fish get the lock for the loan? If you don't know, then when did you close the loan. I need to ballpark when the loan closed as rates constantly change .
I use chase for helocs but not for 'a' paper. I dont feel as though they are strongest there. Dont get me wrong, they are GOOD, but I'm just curious.

again -my apologies, i was under the impression somehow the house condo was 300k -making the YSP quite the gouge. 600k makes the yield a good deal.
big fish charged you basically what i charge, and took it out the back , which in a purchase saves you out of pocket expense. He did a good job.
but i need to know -was this a STATED income loan with those interest rates? Or full documentation of income.
If its stated, what lender did you get?

Yup, only in America! The purchase price was $629K and that is considered a fair price for a 1529 sq ft 2 BR 2.5 bath condo in this area. It's not even move in ready unless you like wall to wall carpet including the bathrooms and wall paper every where.
I've had 2 homes in Texas but have never needed a broker. I got loans directly from the bank since the prices in TX are nowhere close to CA. At this price you can have an estate in TX.
I actually did apply for IO loans with the big banks first but the interest rates were 7% and that is with 10% down.
If my math is correct the "Big Fish" YSP on the primary loan was 1.125% and 1.294% on the HELOC. The first loan was for $503,200 and $125800 for the HELOC.
Thanks Tom and Steve for enlightening me on YSP! I did pay the closing costs with cash and did not add that to the loan. So $5044.45 was my up front closing cost to get a $629K loan. Even better than Steve surmized.

I stand corrected. I thought the purchase price was 300k because the guy was trying to gouge her for 3k or 1% regardless if it funded or not.
If the price was was actually 500k -then the yield on it is abut 1.5 % with nothing out the front. Better deal than most. I stand corrected. Good Job.
Both Steve and I will ALWAYS agree that the Real estate agent making his 5-6% is a JOKE yet nobody complains about that. If steve or I DARED to charge 5 points on a loan this size, we would be SHOT dead. Kind of an uneven playing field isnt it?
The only thing i am confused about it my marvel that you somehow got 6.625% on a STATED loan? 9% STATED heloc on the second?
I cannot possibly believe you can get 100% financing stated income on those rates -when you consider the broker recieved 1.5% YIELD on top of that!
A full doc deal at those rates seems plausible.
If i am wrong , PLEASE tell me who this magic lender is so i can TAKE ALL MY CLIENTS to them too!

Hi Annaliza & Tom,
I've been watching this post develop and I'll contribute my $.02. Let's throw some perspective into the mix.
First, upfront and guaranteed fees (loan closes or not) to a mortgage broker are baloney for residential lending. I NEVER charge this except on commercial loans.
Congrats on purchasing your first home Annaliza! I'm quite familiar with the SoCal market and you are right, prices are still nuts out here. Actually, I think you probably received a fair deal from the "Big Fish" as you call him. Let me explain.
I have inferred some info from Annaliza's posts and extrapolated a few figures after looking at the early May rate sheets from my "A" lenders. I hope that my guesstimates are somewhere close.
The purchase price of the home was around $505,000? We're looking at this as a "stated income" loan with 100% of the price financed? Only out of pocket costs of less than $10K for closing?
The "Big Fish" lender structured an 80% first for around $404K and a 20% second for $101K?
To yield $5,661 to the broker on the 1st loan, the YSP would have been about 1.375%. I don't see a thing wrong with that. Nothing at all unreasonable in the SoCal market to earn that on a $404,000 loan. Usually, I'll earn more than that.
To earn yield of $1,629 on a $101,000 HELOC is only about 1.625% YSP to the broker. Maybe a little stiff, but if there were no loan fees to the lender on the second then someone had to pay them, probably the broker.
If the broker helped you buy this home using a stated income type of loan program, then generally speaking, that means that your "real" income, coupled with your other remaining debt service, is not sufficient to qualify you for that size of loan. I know this was a broad statement, but probably not that far off base.
Another supposition I have made is that you brought no cash to the table to pay your own closing costs, maybe you did, but that would have less than $7,000 or $8,000 maybe.
Tom, do you think the revenue generated to the broker is excessive in this transaction? I didn't see any criticisms of the fact Approximately $10,000 of the purchase price went to the buyer's real estate agent as commission? If the selling agent received both ends then they earned somewhere around $20,000 for the same transaction?
No one is complaining about that.
So, let me get this straight. You were able to purchase a $505,000 property, using less than $10,000 of your own "real" cash in doing so, and secured 2 loans without having to document your true income?
I am not being facetious or critical of you Annaliza, believe me I think it is wonderful that we (as lenders) can do this for people! This is my career, and I love being able to help people buy homes.
Think about this...Is there another country on the ENTIRE PLANET EARTH, where someone can get a $500,000 loan with less than $10,000 of their own money invested?

Equity is definitely not a problem in West L.A. Even with interest rates on the rise Condos particularly in Westwood, CA keep selling at ridiculous prices. I'm confident I can sell in 3 years with a minimum of $100K profit. Hopefully the interest rates will still be in the 6% range.
I really don't want to sell in 3 years because even with a $100K profit I will not be able to afford to buy a home or a larger condo in Westwood. Prices level off during times of financial uncertainty but never go down significantly in this prime real estate area. Too many high dual income families saturated in a relatively small geographic area.
According to my realtor simply adding hardwood flooring to my condo is an instant $50K in equity in this area.
According to Realty Times:
The median price of a home in California was at $548,430 in December, up 15.6 percent from year ago; sales decrease 17.6 percent
The mid-range for a condo in Westwood is about $775,000. That would buy a 2 bedroom, 2.5 bath with about 1,500 Sq. Ft.
Fueled by low interest rates and an ever increasing demand by young, two income families, this terrific central West Side location just saw another explosive year in appreciation. However, we expect the rate of appreciation to slow with the interest rates heading for 6.5%.
Appreciation in more affordable markets is stronger than in the high-profile prestige markets. Some of the high end properties are sitting on the market and having to adjust. Properties under 1,500,000 are still moving although there are more homes on the market these days, giving buyers more choice than they had a few months ago.

Glad you got yourself the 100% financing.
Y'know, some meanines would argue that with even 5% down, you would have got 6.375 on a 30 year fixed, but with mi -and you would have to pay the broker up the front.
Even at 6.99% netting probably 2.5% yield to the broker, its cheaper than the combined ratio that you got on a 3 year arm and heloc.
With the 30 year fixed, the same nay sayers would also argue you could actually keep your home, as prices are not going up and you have no equity, especially in california. So when you go to refi 3 years from now, the interest rates will be 8 % prime, and in fact your house will have DEPRECIATED 10% or more, so you cant refi or sell, being upside down in your home, and thus have to eat the libor adjusting or treasury adjusting rate.
They also might argue that some folks will not be able to handle the payment shock, and go banko. They could refi to an exotic 107% or 115% loans that now have them swimming underneath, just to save the negative equity they have in their house. (Why?)
They may therefore conclude that your 'shark' loan officer, big fish, DIDNT give a rats a** about what is coming down the pike, and just gave you what he thought you wanted, not caring it was the worst mistake you ever made. Hey, he made $7000 dollars off you.
However, I believe houses in California will keep appreciating , and interest rates will still be 6% 3 years from now, so in that case, you did good. You will be fine.

All of my primary loan payment since it's all interest is tax deductable and most of my HELOC (up to $9K a year) is also tax deductable. Could I have done better or should I have gone with a 5/1 arm? The interest rates were higher for the 5/1 arm. I do plan to stay long term in the condo unless the interest rates are really high 3 years from now. I was going to put 10% down but it didn't seem to make much of a difference for an IO loan. The monthly payments were going to be high regardless at this price range.
Only in West LA does a condo cost like a home. I guess that's the price for living in a city were the average annual temperature is 63 degrees.

The broker got a definite chunk there in yield. Better than I would have charged. I charge 1% -especially on loans this size.
what yield means amanda is that whatever rate you got, it almost has to be about 3/4 of a percentage point higher than you qualified for. They did this to pay the broker 'out the back' instead of 'out the front' which you call money out of 'escrow' .
Now, if you only stay in the house a couple of years, it will be worth it. If you stay in it for the long haul, you may have wanted to pay the broker his 2.5% (too much if u ask me) up the front 'out of escrow' and get the much lower percentage rate.
either way - its the same. At least you didnt have to pay the thousands to those guys who try to gouge it out of you right off the hop-therefore basicially 'forcing' you into the loan scenerio they pick for you.

You got socked for approximately $7300 in YSP. That's money that got rolled into the loan. You may not have paid anything up front, but your paying for it over the life of the loan.

Hi Tom, thanks for your input. I can't believe it my self. From almost being swindled to not paying any broker fees. I went over my escrow papers again and the only thing I can find listed under buyer that went to the mortgage broker was a broker processing fee for $55. My total escrow cost was $5044.45. The biggest chunk from that was the escrow fee of $1458.
The 2 big payments listed under broker were Yield Spread Premiums from the lender. One was $5661 for the primary loan and $1629 for the secondary loan.
Apparently the broker I used is the "Big Fish" in West Los Angeles. That's what another local broker called him. This particular broker declined my application with him when I told him I also had an application with the "Big Fish". The "Big Fish" does so much volume that he apparently doesn't charge the loan applicant any significant fees. I got the feeling we was doing me a favor and normally deals with multi million dollar transactions. Luckily my real estate agent had a good relationship with him.
I am very fortunate not to fall prey to the NCM scam. The loan officer Linda Schrader seemed really nice and was very attentive at first. The "Big Fish" on the other hand wasn't very prompt in returning phone calls or getting me quotes so I almost fell for the NCM scam. I was also mesmerized by NCM's low quotes and what seemed to be excellent customer service.
Everyone I knew told me it was too good to be true but I really trusted the loan officer Linda. If NCM told me they could secure the 100% financing loan with a low interest rate I probably would have fallen for their scam. Luckily for me it all worked out in the end.
I hope this rip off report helps somebody from being swindled by Nations Choice Mortgage. If you have been a victim of NCM Report them to the California Department of Corporations, www.corp.ca.gov or the Arizona Department of Financial Institutions, www.azdfi.gov. Depending on your home state. Unfortunately if they have already automatically debited their 1% fee from you checking account you will probably need to get a lawyer to try and get your money back.

My name is Tom. I am a mortgage broker .
I have just been following a post by someone complaining about Quicken gouging them for an upfront 'deposit'- for the same tactics.
slowly but surely bait and switch... reeling them in. However, your post indicates this been taken to a whole new level. I dont know if its legal to outright STEAL thousands of dollars for a loan that never happened.
I have loans all the time that dont fund. I dont charge my clients a cent. The only thing they pay for is their appraisal, and that too quite often can be rolled into the loan.
This idea that 'you didnt pay a cent' to the broker is confusing. If you did a no cost refi -then all the closing costs and broker fees would be rolled into the interest rate and hefty pre pay.
I think what you mean is that the 'fees' came out of the loan proceeds and not out of your pocket.
Some lenders do offer 'broker compensation' on helocs and such, but not on a straight 30 year fixed, unless it was taken as 'yield spread'. Regardless, you pay for it in interest rate if you dont pay for it on the front.
But my hat is off to you for GETTING AWAY from these BUTT MUNCHERS . They are just as retarded as Quicken, and all the rest of the pricks who charge an 'upfront' fee or 'deposit' . This tactic is only to 'freeze' the borrower into the looming ripoff loan.
