I have been harrassed at work and home by NC Cse for child support when their is no proof that the child is mine. They did not offer me the DNA test as required, but say that I refused it.

Every year at tax time they take my refunds for unpaid child support, but that is not possible. It comes out of my paycheck directly. All year long I am fine on payments, but at tax time they magically find arrears that I have to pay. Also, the mother of the child has told numerous people including me that the child is not mine.

My name is not on the birth certificate or any other documentation as the father, but they refuse to investigate. How can you come after someone for child support without establishing paternity fist? I went to court and asked for the amount to be reduced because I got laid off, that request was denied. How can I pay what I was paying when I was employed when Iam now unemployed. I was a seasonal worker, so I was not eligibile for unemployment. The DNA tests now have to be paid for by me and I also have to hire an attorney. This is not fair and Ihope that someone out there can help me. It's not that I don't want to take responsibility for my child.

I just want to know that he is mine before I give the state this money for 18 years. If he is mine fine, But I want visitation, although my money is paid faithfully I have not seen the child in 2 years. If he is mine and I am paying why is that?

I posed that question to NC CSE and the response was that they don't get involved in that part of it. They arte ruining my life and my marriage. Ijust want justice and the DNA test that I am entitled to by law because of the circumstances.

If you want a free test, contact one of these talk shows, like Maury, they do them for free if you are disputing. Get the results (no matter what the result, contact an attorney), if it comes back negative, talk to a lawyer about filing a motion in the court to have all monies returned to you. Whether or not you get it back only the court can decide, but you have the right to sue for the return of these monies and to have your name removed if it was placed on the record. If it comes back positive, you are legally entitled to a copy of all payment and disbursement records through child support enforcement. Get a copy and start going through line by line. If you are the parent, you can file a motion for visitation. Just bear in mind that all courts consider visitation separate from support. If you are confirmed as the parent, and want visitation, get a lawyer and go from there.

No, I am not a lawyer, this is just my personal advice and opinion, hope it helps.

NC Child support is a rip off

Hello I would first like to say that I agree 100% that NC CSE rips off people every day. Yes I do pay child support in NC and I have had so many problems with them over the past 6 years. They are only out to help themselves and the Parent that the child lives with. I currently pay around $400 a month for child support on a daughter that I have seen only a hand full of times in the past 5 years. Just so you know that the NC CSE only reviews a case every 3 years so if you are making good money one year and that happens to be the year it gets reviewed then you are stuck paying a higher support for the next 3 years. I will explain.

When my daughter was first born I done the paternity test to see if she was in fact mine and of course she was. Well at that time I was making very little money so the support was set at a very reasonable $50 every two weeks. Then later on my wife and I moved out of state were I could make really good money and we had a son. Then When my daughter turned 3 they done their review and for some reason took even the over time I was getting into this review. I was working 60+ hours per week and when they did the review my support jumped from around $100 every month to right under $400 every month. Well the city I was living in was a tourist city so when the summer ended my overtime ended and I was still left with this high payment. I couldn't get the case transfered over to the state I was living in which had much better child support laws. I ended up loosing my home because I was spending so much on support I couldn't even afford my house or car (which got reposed to keep me out of jail). So I ended up moving back to NC were my family lives so that they could help out with child care and things like that since I was in such financial trouble. Then I became a single father to my son about a year later and the NC CSE still wouldn't change anything until my three years were up. Well I am glad to say that the next review is in less than 3 months and really hope and pray that my support goes down so I can take better care of my son that I have every day.

about child support...

As a former employee of NC Child Support, I'd like to clarify a few things....

First of all, to the person who states the father is living in the home with them and yet is still being garnished for support that is going to the state..... When Bill Clinton signed the weflare reform act in the 90's, there was a provision that when a custodial parent receives public assistance, i.e. welfare, then any support collected from the non-cusotdial parent will be used to pay back the state for the money given for the child.

It seems as if at sometime you received welfare, and now that the father is back in the home he is still repaying the arrears that accrued during that time, which will go to reimburse the state. Repayment of public assistance arrears is the ONLY reason child support is collected and kept by the state.

Secondly, to the individual who is paying support for a child that he believes isn't his.... Any individual at any time has the option of filing a motion with the court, (the cost is $5.00) for any reason they disagree with their child support obligation. The earlier comment was correct in that when a person starts paying child support their name is added to the birth certificate. However, a paternity test that proves you are not the father can rectify that and names are put on and taken off of birth certificates frequently. ]

You will need to pay for the paternity test yourself, however, as NC CSE gives the noncustodial parent one chance to dispute paternity. Somewhere along the line you should have been asked if you felt the need for a paternity test, and if you refused your signature will be on the Affidavit of Parentage and/or the Affidavit of Informed Consent. If you don't remember signing this form you need to contact your case worker and ask to see the form. It states in clear, precise language that you have the right to a paternity test or you may refuse it. NC CSE CANNOT declare you the father until that form is presented in court with your signature, or a paternity was completed. It's one or the other. No judge will sign an order without one of them.

Something to think about ..the state taking your tax refund

Nikki, my advice to you as far as the state taking your tax refund every year for arrears, even when they have garnished your wages throughout the year is to keep a copy of all the payments that you make throughout the year and put them in their face at the end of the year. As far as paying the child support in the first place, if you dont feel that you are the childs biological father it is your legal right to request a paternity test. But again, since you have already began paying child support, it is on record somewhere that you are the childs father.In NC the mans name is placed on the childs birth cert. when he begins paying child support(if it wasant placed there when the child was born)So you may want to get a copy of the birth cert. to check that out and see if you are listed.NC's child support enforcement DOES suck I agree with you on that. My boyfriend is having his wages garnished(30.00 a week)to pay child support for our daughter, whom he lives in the home with! And the best part, this has been going on for almost a year, and I have yet to see a dime of child support from the state! They have taken money that my daughter actually had every week and now its going to Raleigh to line someone elses pocket.Not only that, i have a 10 year old son that has NEVER received a dime in support from his biological father, who had a paternity test done, yet the state refuses to go after him or even tell me why they have gone after the man that provides for both of my children, but wont go after the true dead beat dad. If all else fails, you need to get a lawyer and go into court to get your paternity test and stop being harrassed by the state, or ease your mind knowing that you have been supporting a child that is really yours and start building a relationship with that child.

you must have signed the acknowledgement papers then.because a court isnt going to take money from you in any way unless there is proof.it is illegal.been there done it all so i know.if you want a paternity then get one.go to the court house and give them the money and tell them you want to request a court hearing for paternity.its that simple! it is 17% of whatever income you get for one child.so if you win the lottery you have to claim it 17% goes to the child.if you get taxes,17% is going to the child support unit.it has worked this way for yrs.you get a raise in your pay your child support automatically gets adjusted.

as for visitation,you have to go to a whole other court case on that.support units dont do that.go see the local probation officer and have it set up there.
