NC CHILD SUPPORT ENFORCEMENT VIRGINIA CHILD SUPPORT ENFORCEMENT UNLAWFULLY COLLECTED DOUBLE CHILD SUPPORT PAYMENTS BY GARNISHMENT IGNORING THE COURT ORDER FOR THE PAYMENT AMOUNT CAUSING FINANCIAL HARDSHIP AND DURESS Winton North Carolina

I have been dealing with the North Carolina Child Support Enforcement agency for some time now and I had been incarcerated in the past for not being able to pay child support in the past because I didn't have a job.  But now that I have a job and I am paying support, what happened to me is shocking, not suprising, but shocking.

I kept wondering why there was so much money being taken out of my check for child support.  Over $1400 was being taken out of my check, which was $700 every two weeks being automatically deducted from my check.  So, on my day off I began to pull court documents to look at the court order with the payment amount on it and prepared to make calls to find out why the amount had changed from $350 on my court order to double that amount. 

When I called the NC Child Support Office, the caseworker didn't know why they were taking out the money and even verified that I was living in Virginia now and Virginia was taking out the $350 for support and I was not even in their jurisdiction anymore now that I have been living in Virginia for over 6 months.  Then she got smart with me and said there was nothing that could be done to get my money back and hung up.

North Carolina and Virginia was taking out the $350 totalling $700 every two weeks on me and thats where the $1400 a month was coming from.  So I called back and asked to speak to a supervisor.  The supervisor admitted that North Carolina shouldn't have been taking out the $350 and that a stop payment would be put in effect.  They are supposed to be sending me the money they took out next week but that remains to be seen. 

My point is, they knew that I didn't live in North Carolina anymore, the caseworker verified my Virginia address when I asked her what address was on file.  Yet, she got smart with me and said nothing could be done so if I accepted her answer, I wouldn't have had a chance to get my money back had I not called the supervisor back.  I am waiting to see if they send my money back next week, but the fact remains, I don't have the money I worked for to pay bills and the duress it caused me in addition to not being able to pay my bills or take care of my family will not even be addressed while I wait to get money back that I already worked for. 

Something needs to be done about the Child Support Enforcement Agencies that hammer down on people by incarcerating them when they don't even have a job and taking away the ability to even look for a job because they are incarcerated being treated like a criminal and that is not in the best interest of the child either. Also, the non-custodial parents do not have very many alternatives for help and people need to stop stereotyping every dad because not everyone is a deadbeat dad who doesn't want to take care of their child.  The bottom line is money.  But, like I said earlier, who stands up for the victim when the table is turned and the Child Support Agency takes money that they know doesn't belong to them and causes a family to suffer and fight for what rightfully belongs to them, the income that was worked for that was snatched by garnishing a check they had not right to take.
