I would like to respond to the author of The Sherman Oak article regarding Neptune Society's misclassification of employees and to gain additional information from this author.

It would appear that Neptune has been aware of this issue for quite some time.  It was last year that you posted this article, they have not changed their business model as of today's date and I find myself in the same situation.

This company exercises significant control over its sales reps, I am looking for other reps to comment on this and disclose if this similar situation is occurring in other parts of the country.

In response to your posting from Colorado.  You can file a complaint through the IRS that Neptune Society misclassifies their salespeople as independent contractors vs employees.  This is the slow route to take.  I have filed an SS-8 form last October. They responded with in 90 days saying they needed more time.  My whole purpose of filing this with the IRS is simply to get those wages entered into my Social Security earnings.  The IRS is the collection agency for the Social Security.  I'm willing to put in whatever time I need there because I already won my decission in the state of California against Neptune Society.  My case for unemployment was heard before a judicial Law Judge here in California and a ten page decission was made in my favor regarding being an employee rather then an independent contractor.  All the appeals process has now run out for Neptune Society in regards for that case.  I have since forwarded that decission onto the SS-8 division of the IRS because the IRS has a tendency to follow state rulings.    Your first step is to file for unemployment with the state.  In my case the leads dwindled down to nothing and I couldn't afford to hang out at the office anymore because in essence what they were doing is laying me off.  Because you have no wages charged to your account and you will get your first denial you have to appeal it on the basis that Neptune Had you misclassified as an independent contractor rather then an employee.   One of the biggest items is control.  However I believe the second item that is even bigger is that this area of sales is essential part of their business so therefore they can not use independent contractors for this portion of their business.  It combines with the control part because it is an essential part of their business and they have to control this part of business.    Good Luck..
