Norvergence proposed to me to provide voice,data,free long distance on office phones and 2 cell phones via a small Matrix Soho Box. They promised to buyout my existing contracts with my current companies for the office and my cell phones.(they were never contacted by norvergence)They would save me approx. 240.00 per month. After signing a preleminary lease and guaranty that was not fully filled out until Norvergence had fully connected us, I find out from Sterling Bank of N.Y. that Norvergence had completed the lease and assigned it to Sterling Bank. Sterling is demanding payments be made now or face serious consequences.

The box was placed in a closet but never connected. After the box was delivered on April 16, 2004, I was not able to get anyone at Norvergence except one time when I demanded why I was getting bills from Sterling Bank and I was not yet connected. They told me to not worry Norvergence would make any payments until i was fully operational.

After that I could no longer get anyone. I called the Sterling Bank and was told that Norvergence was in bankruptcy, SEND PAYMENTS NOW. I wanted copies of all paperwork effecting the assignment. When I got them I saw that Norvergence had finished filling the blanks and Lessee and transferred it to the Bank. This was done 3 days after the original signing of the partial contract.
My attorney is filing a letter with the bank setting aside the validity of the lease agreement.

I am also joining in the co-op considering further action to dis-claim the validity of the Lease.
I am finding out some bad reports about the founders of this Scam.

I did the same thing. I contacted the leasing company and asked for copies of all the paperwork that they had.

Mine did not match theirs. The matrix box was typed in on mine.....and on theirs, there was handwriting for phones. The lease was altered after I signed it and you think that this would be null and void.

The delivery and acceptance certificate does not match the one I have here. There is script on mine and theirs is in printing.....there is definetly something going on here. Let me know your attorney's name and phone number, this way I can get copies to him.

Who knows, maybe there IS something that can be done.

Sounds familiar

Our company is in the same position. Equipment was delivered and then that was where it stopped. Could not get a hold of anyone at norvergence. By phone fax or email. A few weeks later they go Belly-up. Now it has only been 3 months since my lease was started and the Leasing company Wells Fargo has already filed a suit to collect the balance of the lease.

I am not Lawyer but this seems a little fishy. I have never seen a bank file suit against some one for be in default for 2 months.

I now have less than 20 days to respond to the suit which was filed in an Iowa court to fight this. Is this even legal?

Has anyone else been served papers from the court claiming that they have breeched there contract with the leasing company and the leasing company is demanding the lease be paid in full?
