I had an automated plan set up with Palm Beach Tan to withdraw $60 each month for tanning services. I cancelled the plan on October 16, 2009. Their cutoff date is the 25th of each month to ensure that they do not charge you the next month.


However, I was warned by the girl working their to keep my copy of the cancellation. That way if they did pull out funds then I would have proof I met the cutoff requirements and that would ensure that I got my money back. Sure enough on Novemer 2, 2009 they pulled $60 out of my account. I went into the salon and showed them my paper, they claimed that my first draft got misplaced and was never sent to their main office and that was why they pulled out these funds. They ensured me that they would correct this by putting the cancellation in and a request to refund my money, which would come in 4-6 weeks to my homw address.


To my surprise and utter dismay they pulled money out again on December 2, 2009. They now have charged me $120 for services I did not receive and requested to be cancelled. I went again into the saloon and tried to fix this. They said they completely lost my papers and a manager by the name of Heidi requested that I bring in my original copies to the salon so she could pick them up and process them. I did that on December 7, 2009. Since this time I have tried to contact both Heidi and Palm Beach Tan's answering service. I have left over 10 messages between December 15, 2009 and January 15, 2010 and have not received a call back from anyone on the status of my reimbursement.


I have not received any of the money that PALM BEACH TAN STOLE FROM ME!

Same thing happened to me.

I was a member of Palm Beach Tan in Timonium, Maryland. I cancelled my membership on 2/1/10, understanding that I would have to pay for the month of February. I din't check my March AMEX bill but when I went to pay the April bill, I saw that PBT had charged my account as of 4/1/10. I called AMEX and learned that PBT also charged me for March as well.

 

I called PBT and they told me I would have to come in to their office to get this resolved. I refused, since it would have been very inconvenient. I did fax them a letter demanding a refund for March and April. I also re-read the cancellation form which states, in part, "If billing continues after cancellation, you must notify us within 90 days." (There's no explanation for what happens if you don't notify them within 90 days.)

 

In any event, based on the language on their form, I suspect it is one of their ordinary business practices to continue charging after a customer cancels in hopes that the customer won't catch it. Nice source of unearned income. We'll see if they send me a refund. Based on Erica's experience, I'm not holding my breath. I do plan to file a complaint with the Maryland Attorney General Consumer Protection Division and I am investigating a possible nationwide class action. According to PBT's website, they have close to 200 locations in 21 states and DC. Stay tuned. I would love to use Erica as a class plaintiff if there is some way that Rip-Off Report could provide her with my email address.
