NY State has adopted the "warranty of merchantibality" afforded in the Uniform Commercial Code. Basically, this means that an auto dealer, selling an auto, has to be sure that the auto is merchantable - it has to be suitable for the use that it was manufactured for.

The transmission issue violates this implied warranty. Further, as a car dealer in NY State, they know this. Also, there are certain forms that they were to provide you that indicate this implied warranty. If they didn't you have another "bullet" for your formal complaint with the AG office.
