I received an elaborate email offer for a free Sample sleep aid product called Somnapure. The offer indicated that I only needed to pay 2.99 for shipping and the company Peak Life would provide a 30 ct. sample via usps shipping.
They seemed professional and customer oriented in acknowledging my order and encouraging me to read about their product. I am aware of internet scams happening but when I perused the web site and the order-confirming email I could find no reason to suspect any shady practice here. In other words I made a conscious effort to look for some deception and could see none initially.
Anyway, the product arrived within a few days and I tried it. I was not happy with the effects after my first use and did not try it again. I thought the company might contact me to ak about receipt of the sample or my reaction to it but there was no such follow-up. I simply placed the Somnapure bottle on a shelf and thought I might give it one more try at a later date
On June 28, 2014 I was checking my credit card charges and found that Peak Life had charged the same credit card which I used to pay the 2.99 shipping charges for $34.98. Since I had not ordered the product; I didn't want the product and I hadn't received the product, I immediately wrote to peak Life responding to their email message which had confirmed shipment of the Sample product. That email was returned with a message indicating that they did not accomodate emails and that I should call their 877 number. When I called I received a message that they were closed for the weekend.
I called early Monday morning and was kept on hold for over 20 minutes listening to music. This happened again when I reattempted to contact Peak Life in about a half hour. I believe the practice is to discourage customers from holiding on.
I searched the internet and found several reports of deceptive practices by Peak Life similar to my experience. One was almost identical to mine!
I then contacted my credit card company and filed a dispute relative to the 34.98 charge by Peak Life for Somnapure.
I called the 877 number for PeakLife one more time after the call to the credit card company and this time they answered within 5 minutes and I had a chance to tell my story. The Representative explained to me that near the spot on their web site where I made an affirmative request for the sample there was mentyion of an agreement on my part to participate in a "Trial" of their Somnapure product and that I had agreed by ordering the sample that after 17 days of receipt of the product I had legally agreed to purchase a month's amount of Somnapure!
I told the Rep. (Tim) that I saw no such explanation of a "Trial" program and that every web page I visited merely referred to the "Free Sample" with no asterisk or any other indication of any agreement that went beyond receipt of that sample. Even in their Trial disclosure which appears under a "Terms" button on the very bottom of their web site page they can only initiate a charge after receipt of the sample and Peak Life made no effort to verify receipt, satisfaction or any attempt to determine any level of satisfaction with their product before initiating further charges prior to placing the (unauthorized order) and making the shipment under question.
I informed him that if there was something to be discovered on the web site it would have had to be pretty obscure and intended to be deceptive since I am a normally skeptical and careful customer who does not ordinarily use my credit card in these types of circumstances.
The upshot was that I was told that the product was already on a truck for delivery and after some haggling was given a Return to Sender instruction and 7 digit number to write on the product return to obtain full credit which would not be provided until the product was returned.
I infomed Tim that I had already instructed the credit card company (Capital One) to dispute the 34.98 charge and would make every effort to inform the publilc of Peak Life's deceptive practices.
So, I am entering this Ripoff Report because all indications to me are that Peak Life intends to ripoff people rather than simply market a true Sample to develop satisfied customers that they can market to. I hope this report forewarns other consumers of the true nature of the Peak Life deceptive business practice that I fell victim to.
