Hi,


Today at january -06-2010 at 2:00 PM Eastern time I backordered www.with.ca


The pool.com allows to backorder until 3:00PM eastern standard time.


And it showed that they accepted my backorder and the backorder capture in progress was also shown after wards.


But than at arounf 5:30 pm Eastern time, NY I am seeing that www.with.ca is not in my sucessful backorder with pool or other companies I had backordered.


Than I looked at whois information of www.with.ca


And this is what I saw

This clearly shows that Pool.com employee has pocketed the backorder.


So beware.


If its a good domain and you are the only one who has backordered it.


the pool.com guys will not give it to you according to agreement.


But they will pocket it.

I can understand why the individual who reported this issue may have got the impression he did, but his comments demonstrate he does not understand the CA Drop.  Here are the details.

1.   CA auctions start the moment we recieve confirmation that Pool.com was successful at acquiring the domain.  When we have multiple backorders, all domains go to auction.  In this particular case, the auction for "with.ca" started on Jan 6 at about 9:00pm. 

If this customer had indeed placed a valid backorder (which I cannot verify without additional information) then they would have been automatically placed in the auction as a valid participant.  I do notice in our history however that one backorder was placed at 7:20pm (GMT) but the domain was actually acquired at 7:00pm.  To be accepted as a participant in an auciton, a backorder must be placed before the domain is acquired.

2.   The auction closed on  Jan 11 at 4:00pm.  The winning bidder then has a period of time in which to complete payment.

3.   CIRA, the registry that operates .CA, operates a thick registry which means a registrant must be provided on initial registration.  When the registration occurs in advance of the auction, the ultimate registrant is not known.  So, Pool.com registers the domain in my name pending the outcome of the auction.

4.   Once the auction is complete and the auction fees are paid, a process called a "domain merge" must be conducted which moves the domain from my name into the name of the auction winner.  This process sometimes takes a few days.

Pool.com does not register domains for ourselves, we only register domains for customers who place backorders.  Occasionally, we get stuck with a domain registration when a customer refuses to pay or turns out to be fraudulent and no other auction participant or interest exists.

I welcome any inquiry from anyone that wants to know more about the CA TBR process or the Pool.com drop program.  And I encourage the author of this report to contact me directly if there are still unanswered questions.
