Ms. Arlyne Szerman, Realty ONE Group in Santa Clarita, CA, has been acting in a very unprofessional and untrustworthy manner.

My wife and I entered into a purchase agreement with Ms. Szerman's clients for a townhouse in San Fernando, CA.  After investigating the property and discovering major issues with the homeowners' association, we elected to exercise our right to cancel the contract on 10/23/2015.

Despite numerous attempts, both through our realtor and directly, to get this resolved, the cancellation document remains unsigned by the sellers. Even worse, Ms. Szerman has not only relisted the property, but listed it as "Active". As she surely knows, this is inaccurate, as until her clients sign the cancellation documents, the property still has an open sales contract and is still in escrow.

I was surprised to get a notice of a rebuttal to my complain nearly two years later.  At any rate, it is inexcusable for a realtor to re-list a property that still has a sale document open and pending on it.  Even if it might be technically within the law, it is morally and ethically wrong.  

As far as "making" the client do something, you had the only leverage in this situation: you could have refused to re-list the property until the purchase cancellation was signed.  This was being done punitively since we back out of the deal, even though it was for a very legitimate reason - the HOA had serious financial troubles.

I don't claim to be a real estate expert, but to hide behind a weak excuse of "I had no choice" doesn't recommend this realtor me.  We subsequently found and purchase a great townhouse using an honest and excellent realtor where no problem occurred.

As a Realtor, I can only do what my clients ask me to do.  In this case, the buyer wanted to cancel the escrow after demanding repairs which the seller did and keeping the house off the market for them for over 30 days.  My sellers were furious and refused to sign the cancellation. I tried to get it signed but they wanted the buyer to have to wait, like they did, until a new buyer came along.

If you have a complaint it should be with the sellers not with me as the Realtor. I could not make them do what they did not want to do. You were not my client and I must do what my client tells me to do. That is my job.
