This company had been contacting me for over a five or six month period in 2007-08 about an old credit card account that had been off since the beginning od 2006 and said that there was a balance still due. First off to start the account was not assigned to them for collection. I paid the account off through a totally different company and had the paper work to prove that it was paid off. Because I had recently moved I could not find it right off and went ahead and made a payment to Resurgent capital and had an agreement that when I found the paperwork and sent it in to them I would have the money that I paid to them refunded and here it is 4 months later and everythime I call they say that it has been sent in the mail. I have not received anything in the mail and the account is still being reported on my credit.

Never ever pay any dirtbags. You might not see your money. From their stand point. Statute of Limitation has been reset. They do not recgnize your payment in full from the other company. These debts are sold off with no records provided to the buying company.

Therefore, Stop dealing and take action. File a complaint with FTC.gov. File a complaint with your attorney General. Go to Debtorboards.com and tell them your story. They will have suggestions. It is free. The do not sell anything.

The scum bums from Resurgent don't care if you paid. They will call and harass. I would get a tape recorder and start taping their calls. You have rights under the Fair Debt collection protection Act. Read about them on Debtorboards.com . I am not an attorney. I just care because I been where you are. They helped a lot. Get smart!!!! and file the complaint with the attorney General office. Give them the proof that you were taking about. They will tell you anything to get you to pay. Then they will lie about no such agreement. So you need to get them on tape acknowledging the agreement then go into court and sue. Get your self an NaCA.net attorney. They are good.

When I read it, it appeared to me that Resurgent was attempting to collect on this debt that she had previously paid to another company. That's where I came with the cease communication letter if they were still attempting to collect, that's all. It seems that your post is probably right, and she SHOULD get her money refunded from Resurgent if she has already unfortunately paid another company.

I'll try to read these more carefully before posting, thanks.

The OP is trying to get the payment she made to them refunded because she finally found her paperwork that proves she paid the debt. So, WHY would she send a "cease communications" letter to them?

What she should do, is send a certified letter to them with a notarized copy of the documents that prove the debt is paid and demand the refund of the payment she made. She should also affirm to them that she expects them to contact the CRAs to have any listing of this debt REMOVED from any credit reports about her.

NEVER pay a collection agency

Nobody should EVER pay a collection agency under any circumstance. For one, they are not your creditor, and two, it appears like you'd already paid this account. Hold onto your paperwork, and send the collector scoundrels a letter like this to stop all collection communication with you. Good luck! This will serve as your legal notice under federal law of the Fair Debt Collection Practices Act of Congress (FDCPA), to cease ALL communication with me in reference to the above account.

If you don't follow this notice, I will be forced to file a formal complaint against you with the United States government agency, the Federal Trade Commission, who is responsible for enforcement, the state Attorny General's Office and the American Collector's Association who monitors collection agencies for non-compliance with this federal law. I have decided that I don't desire to work with a collection agency under ANY circumstances. I will contact the alleged original creditor of this alleged debt to resolve this matter directly.

You are also notified that if any adverse items are placed against my credit reports as a result of this notice that I will be forced to take appropriate action against your agency, your client and any person employed by either who violates this federal law, with civil and/or criminal charges.

Give this matter the attention it deserves as the consequences could be severe.
