This contractor was hired to replace a roof ad complete extensive wood work due to hurricane damage.  They requested a 50% retainer, which I regretfully paid.  The construction was delayed for 2 months, and not once had anyone from this so called company contacted me.  A 'project manager' that is actually just a sales man promised the world, but then disappeared from the picture.  It took weeks before I could get someone on the phone for this company, only to hear empty promises and lies.

A container was dlievered and a week later a Mexican crew that did not speak English appeared and started the work.  The crew supposed to have replaced wood rafters and all damaged wood on the roof.  What actually happened was that this crew only patched up wood damages, nailed new parts against damaged and rotten wood, they did not secure any wood rafters and then nailed shingles on top of damaged and rotten wood.  But to make it worst, they never finished the job.  A written proposal was signed by their General Manager Tim and accepted by me and it was very clear what work had to be done, but all of a sudden I was told that there is not enough money and I have to pay out of pocket.

As I refused and referred back to the signed proposal and agreed price I received threatening phone calls from the General Manager, he cursed at me and yelled at me over the phone.  He threatened to place a lien on my house.

I reported the copany to the Better Business Bureau and also to the Chief Building Inspector of Duval County, and ask to forward a complaint to the State of Florida for breech of contract and because appropriate wood work permits were never pulled, but the city of Jacksonville passed the inspection of the roof although the work has not been completed.  A Jacksonville City clerk informed me that the city only inspect the parts for whic a permit was pulled - in my case only for the shingle replacement.  

After placing shingles on damaged wood, spaces under the overhang of the roof were left open and can be accessed by rodents and what not, as well as being subjected to the weather.  I have rafters that are exposed to the weather and roofing strips around the house were nailed on top of damaged wood.  The agreed work also included wood replacement on the car port and siding (under the roof) as well as a paint job, but none of this work has been completed.

Now I am getting roofing estimates to repair the botched roofing job that was done by RMX, I have to get a seperate wood contractor and fight to get my money back.  It is unbelievable that such a company is still in business.

It has been several weeks and this issue is still not resolved.  The Better Business Bureau complaint stand valid and open and is still on-going.  Several attempts to negotiate with the contractor have failed.

This contractor believed that my complaint will go away, because I am disabled and often challenged due to my health, but I will follow this through to the end.

After informing the Better Business Bureau of the situation and after pictures have been reviewed RMX was contacted by them with a request to solve this issue.  Each time the BBB contacted RMX they also contacted me and came up with bogus excuses and settlement suggestions.  

After my lawyer contacted RMX to give them the opportunity to speak before a law suit would be filed, the General manager Tim immediately called back while I was still in the lawyers office and suggested that RMX would walk away from the contract and file a satisfaction note on the now placed construction lien on my house, in turn he requested that I send a statement to the BBB explaining that the issue has been resolved and the case can be closed.

I agreed to those terms and my lawyer drafted a letter giving RMX 10 business days time to remove the lien, give a written statment that they walk away from the contract as it is and draft a letter to the BBB for me to sign.  This letter was mailed and received by the General Manager Tim, but he did not respond.

In fact RMX did not respond period until the BBB send me another email asking for the progress of my complaint. Therefore, it appears that RMX is only willing to co-operate under pressure and I am no longer willing to play their game.

Tim (GM) again suggested that he will meet me this past Friday and he will walk away from the contract etc.

But I am no longer willing to participate in this BS, but instead want to have my house fixed and repaired as intended from the beginning.

I am filing a law suit this week with Duval Court for 

1. Breech of contract (RMX was hired as a general conractor not as a roofer alone, and work was never completed)

2. Placing of a fraudulent lien (the lien amount is higher that the original contract value)

3. Return of money paid and payment of all repairs needed on 'completed work' in excess of the money that is available as needed and the court sees fit

I will follow uo with the results of the law suit.

RMX has now or is in the process of filing a contractor lien against my property.  

1. the amount of lien is higher than what was agreed upon per contract

2. RMX reasoned that the city passed inspection on this roof

3. according to RMX this job has been completed.

This is a very cruel joke.  I just took pictures and of course file file a contest of the lien, but after I spoke with the chief building inspector's office of Duval county and let them decide if this roof should really have passed inspection.  Previously I have been told by the same office that a permit was pulled only to replace shingles and that is what the city would inspect and not any wood work, but as anyone can clearly see, the wood work on the roof is actually part of the roofing job. A complaint has been filed with the Florida Department of Bisiness and Professional Regulation and a follow up BBB complaint will also be filed. Legal representation has been obtained, but there is allot of legwork and paperwork that is involved.

Additional damages such as a damaged driveway and oil and rust spots on the same from the construction container that had been left at my house for 2 months, as well as a broken light fixture with a cut electric line and inside ceiling water damage from a leakage that occured during the last hard rain around the kitchen ceiling fan outlet.

Per BBB complaint # 12872738 the General Manager had admitted to a faulty job and offered to reimburse and/or pay for roofing repairs for anything that is needed. But as a real response I received the lien notice on my property.  The GM also never mentioned anything about the promised jobs that have not been touched.

I hired legal representation and I will update this file at a later point.
