SAFEWAY INSURANCE Didn't want to pay claim .My car was hit and totaled by a diesel.all safeway was supposed to do was total my car out and pay it off.They didn't want to do that the diesel was at fault my lawyer just needed safeway to total the car out.they gave some lame excuse about my husband not being on my policy not only that they all of sudden my policy saids i have no kids are husbandl LAFAYETTE Louisiana

Safeway Insurance does not want to pay my car off after it was totaled by a diesel truck.Mind you full coverage but they don't want to pay my car off eventhough the will be reimbursed.Not only that the agent preceded to tell me that my policy I signed stated i was single with no children.I have a wedding visible on my finger and my two daughters were with me when i purchased my insurance.a 16 yr old and a 14 yr old.Then he stated my husband was not suppose to be driving which i told him he wouldn't have been if the roadside assist would have came because his dl are suspended.ok i didn't ask them to pay for my husband he will be taken care of.but,iv'e lost my car i have no rental car my husband is hurt and i can't get to work because my car is totaled .i run my own business which is daycare.so i can't pick up or drop off.and these people are jerks you pay money for coverage you never really had in the first place and nothing is being done and they just keep getting away with it.and i just can't let this happen...

What i'm guessing happened here, You told the agent that you were single and had no children since you had 2 daugthers that will soon be getting their drivers license which means your premium will go up. Oh and yeah letting your husband drive with a suspended license was not your best move! The MOST LIKELY reason you did not receive any payment from the claimant insurance company is that your husband was not on your policy AND he was driving on a SUSPENDED license and Louisiana has a law often referred to as No Play No Pay, which means if the "at fault" insurance company is not require to pay if the other party is not insured.

There rejection is likely because you knowingly allowed someone with a suspended license to drive the vehicle. No insurance company is going to cover that. What were you thinking? The result is about the same as if your 14 yr. old was driving and had an accident. I'm sure your policy mentions an exclusion in coverage if you hand over the car to an unlicensed driver. Forget Safeway. The moment you handed over the keys to a suspended driver, they considered you uninsured. They are not going to help you.

On the other hand, if the diesel truck was truly at fault, you have a chance to collect from its insurance policy. Even though your husband may have been driving under a suspended license, the other driver's insurance cannot deny liability because of that if the diesel truck driver actually caused the accident. You will have to make a claim with the other driver's insurance company.

If I understand what you're saying you allowed your husband, who has a suspended license, to drive the vehicle? If this is true then you have violated a policy condition. It's a requirement of ANY auto insurance policy that anyone driving the vehicle MUST have a valid license. If they don't then the insurer has grounds to deny any claim that occurs from an accident involving the unlicensed driver. So unless you're planning on changing your story and claiming your husband stole the vehicle (and are willing to press charges) I'm afraid you do not have a leg to stand on.
