  I have been involved in a Child support case at the North County San Diego court house that went from June of 2013 to March 2014. I was quite amazed at how sexist the whole process was and how sexist the court staff was. One example was my ex claimed health issues had made work not possible for alot of 2013 and thats why income was low. The judge let my ex claim all kinds of business expenses for 2013 though, when I questioned how my ex could have all these business expenses but also be unable to work due to health issues I was cut off midsentance and told that it had already been ruled on. My ex is self employed and brought only income and expense statements that my ex had filled out and the amounts of expenses constantly changed ( $0 to $1500 a month rent) which was never questioned by the court, while I had to bring those in along with bank statements, paystubs and proof of health care coverage payments. It was like whatever my ex said was fine and taken as fact but I had to prove every little detail. My ex was allowed to speak and bring up points but I was rarely asked for input and when I tried to speak or defend myself I was talked over, cutoff, etc. It was so bad at the last hearing I gave up, sat down and just listened, almost frozen in disbelief. I am the male/father in this situation and almost everyone I dealt with at the North County San Diego court house in Vista was female. It is very sad that the system and the people that are supposd to just work in the system are so biased and unfair.

As we already know you can say and write what you want on any legal document, however IS IT TRUE.  Declarations are signed under penalty of perjury and everyone lies (for the most part) on their declarations.  Family Law is one of those areas of law whereas everyone misses the underlying issue. 

If you want to see if the other party is not being honest, you can file a document that requests that they tell the truth.  See law library.  In all cases you can request a particular document by way of a request or motion, you can also object to a particular document through a document.  You also have the right to order the transcripts to see what was said at your last court appearance to be prepared for your next court appearance.  Ignorance of the law is of no excuse.

Before going to a court hearing/trial research the interenet and look up court hearing and trial preparation so that you may be prepared to respond to any documents and or prepare a document to be responded to.  There are various types of motion and other documents you can file before your court hearing and the time in between.

Case law and codes will always give you your rights and how to obtain them. 

Judges cannot give legal advice and must make their determination based on what is before them.  In Family law in regards to child support and custody - it is simply modifiable but you have to find out what Motion to do such of that.

The law library is the source to use to learn about documents to file on the other party.
