False foreclosure on my house. They sent me a letter saying they could stop it. I completely described the situation. Marke Burke came to my house late at night, claimed to have a"standard real estate contract." Also wanted power of attorney to contact the trustee. Thing is, he already knew I was not going to refinance a fake loan. But insisted that is their "strategy. Listing price on house was 50-70 K lower than it should be. Contract says that BROKER can change the price. Basically says if they bring you a lowball investor price and your refuse it, you STILL have to pay them. I was NOT give a copy of the contract. Mark Hicks claims they do not have to do that, only after three days. LIAR. Contract is absolutely predatory. I signed after hours of "conversation and it was late. Marke Burke failed to leave me a copy of the contract. Bt finally gave me one via email. I canceled immediately. He refused to cancel . Finally, kept saying he was going to sell my house instead. Mark Hicks (the owner of this house of scam) then calls me up bullying me, telling me I am trying to defraud THEM and just want to sell it through someone else. He also admits they have only one time paid out the $2000 if they cant stop the foreclosure. Basically, they have one of their "investos" write a lowball offer. You don't accept it, they still get paid. But all they do is use a bunch of unethical delays to stall the foreclosure and stress you out until they bring in a lowball offer and force you to pay them. They have no real power to stop a foreclosure. Mark Hicks (yes there are two Marks involved) tells me that he will cancel their scamer contract only if I pay them if i try to sell it within 90 days. it is my opinions that Mark Hicks is absolutely the most unethical, predatory, Real Estate agent I have ever encountered.

They do NOT act in an honest manner and do NOT honor their feduciary duty to the seller!

I seem to have complained about everyone who has tried to help me? LOL. That is pretty funny. This gets better all the time.

FACT #1: you do nothing for free. You advertise that you can get investors cheap properies then prey on homelowners in distress and list their houses well below market value, then bring in your own investors to make offers, which, if the owner refuses, they still have to pay you. GROSS MISCONDUCT.

FACT#2: you demand a listing months in advaced. This is in violation of MLS. You are repeatedly in violation of MLS regulations. This is currently being reported to MLS with the evidence of contract and failure to list.

Do I have to submit my listing to the MLS?

Yes. Broker participants and their agents must input exclusive right to sell or exclusive agency listings on one to four unit residential property and vacant residential lots located within the service area of the MLS within 72 hours (with no exceptions for weekends, holidays and postal holidays) after all necessary signatures of seller(s) have been obtained on the listing (7.5) or they will be fined.
If the seller(s) do not want the listing included in the MLS, participants must submit the Authorization to Exclude Listing from the MLS form to MLSListings within 72 hours (with no exceptions for weekends, holidays and postal holidays) (7.6). Failure to submit listings as described herein will subject you to a fine.

You will be fined and when MLS reserches the evidence of your fraudulent business practices, you will have to face your actions. Any agent asking a person to predate an MLS appication is acting in violation of the MLS rules and behaving in a fraudulent manner inconsistent with their feduciary obligation to tir license as a Real Estate Agent or Broker. Given that all parties listed for Seabrooke group are liscened brokers AND the lead Broker is Mark Hicks, there is absolutely no reason that after 25 years of nefarious practice, you should not know this. UNLESS you are obtaining MLS agency agreements with he intention (which your ongoing businss practices indicate) in order to privately obtain control of a property in order to seretly  provide it to unscrupulous investors.

 

FACT #3: Your pattern of refusal to honor California Contract Law.

FACT #4: It is illegal to operate as a mortgage foreclosure consultant—that is, to perform any foreclosure-consultant service—in California unless the foreclosure consultant has obtained a Certificate of Registration as a Mortgage Foreclosure Consultant from the Department of Justice. In order to obtain the required Certificate of Registration, a foreclosure consultant must complete the application and provide all required documents to the Department of Justice.

Therfore, please immediately post your license and a copy of your bond.

Paulette please look at the attachment that you signed with us and left here for others to view it spells out NO MONEY TO BE PAID TO US UNLESS WE SUCCEED !!  Please include that in your ripoff report it costs us an average of 3500.00 to $5000.00 per client in time and money to get these done and that is the part you do not understand but THANK YOU FOR POSTING THAT WE APPRECIATE IT !!!! Thanks again !!

I do not know who you are but I will assume that you are the person in Citrus Heights who I have never met. Our office is in Campbell and we have helped many clients over the years and a lot of them for FREE I will gladly let you talk to those people. I have their numbers and have told them about you and they are willing to tell you what we do. As far as the 90 day cancellation that is standard. We cancelled with you so I do not know what the issue is now. I was not calling you a liar I was just pointing out that you want to trash our reputation with garbage. The facts are clear you called us we did not call you. You took out a loan cashed the check and made payments on the loan. That is different than what you told us.

You stated that the loan was fraudulent we called your lender and verified that you made payments and then you remembered that it was your loan. We never charged you a dime. It is against the law to charge any fee upfront if you are a Real Estate Broker. This we know and we abide by. As far as copies the agent asked if you wanted to go and get copies we do not have copy machines in our car but maybe we should. As far as I know he could have taken pics of them for you I do not know where you got the three day rule but maybe it is from the same source that you got your loan info from. I always like to have all of the facts on display for all to see and we explained everything to you if that was not done then you have my apologies.

We informed you that the bank was foreclosing for non-payment you wanted to sue everyone about the loan you took out on your house. A short sale is a difficult process as you will see and with no income you do not qualify for a loan modification as we told you but you have other options and we informed you of that. You are welcome to complain to the Real Estate Board or whatever agency you choose because we have done nothing wrong. I wish you well in whatever method you choose to try. We do not do forensic audits, promise you the sky or anything else. We simply help those that need help if we choose to. I wish you well but the clients that have actually done business with us are happy joyous and free of the problems that you have right now.

Just so you understand you had no equity and no source of income that would qualify you for any of the lender programs. There was no mysterious investor that wanted your home. If you really need help then we can point you to an attorney that could help you other than that we have no more contact with you except when you want to write things on the rip-off report the good thing is that we get to respond to anything that is written here. After that we get call from people who want to charge us $7000.00 to take it off the internet so we choose just to respond. Good luck Hope that you understand there was and never was any profit motive for us because there was no guarantee that we could get paid from any source the lender or you.

Nice. Your defense is just to call me a liar. Wow. You know I stated I wanted to cancel immediately with you. You know you "accidentally did not leave a copy of the contract. you know Mark Hicks claims you do not even have to do so until after three days (uh, wrong). I know I stated that I did not want to refinance a fraudulent loan. You know you stated that your claimd "in-house" attorney immediately told you that there was nothing you can do for me. You know that you have not paid out on the $1999 more than what one time in 20 years as Mark Hicks stated if you actually stop a foreclosure. You guys are just another predatory real estate company. ANd all of Mark Hicks garbage about refusing to cancel the listing, which was NEVER listed (again, you are required to register a listing on MLS within 24 hours of receiving it), was a deception. It is my opinion that you are shady and unethical in your business practices. You are trying to bully me into agreeing to pay you for 90 days. I will not. You are not to contact my lender ever again. All contracts are hereby and previously fully canceld. Your lack of regard for your feduciary responsibility to your clients is abysmal. As is clearly evidenced by your response here Mark. Thank you for proving my point!

This comment is completely false. I will point out that you contacted us about doing a loan modification based on the scenario that your home was in foreclosure because someone had fraudelently got a loan on your property. This we found out not to be true as we found out that you had secured the loan cashed the check and refused to pay the money back. The bank took years to foreclose on you and you wanted us to either modify your loan or sell your property. Our companty agreed to do what was necessary to get the job done. Your home was priced below market because frankly it was not close to the level of the previous sales in the area. We do not have anyone or any low ball investors interested in you area and you were told that. It seems to me that you have complained to everyone including the Department Of Real Estate about every Realtor, Loan Company or anyone that ever tried to help you. How can we be predatory when the house is not worth what is owed, it is in bad condition and there is no way to get paid obn your house. We gave you a standard cancellation and we talked to you and told you that and sent you a cancellation. As far as bullying you I have no idea what you are talking about but we do record ALL of our conversations for quality control and will gladly send you a copy. We explained to you the foreclosure process and your rights. We cannot stop them when you do not cooperate with the bank. I think that your problems lie elsewhere as we have been in business 25 plus years with no problems with the exception of this ripoff report that charges money to get stuff like this removed. We will not deal with you further but if you do not stop making false staements then we will exercise our right to defend ourselves. By the way the bank showed you and us that you in fact got the loan and paid on it so the foreclosure is not false.
