Our Broker refinanced us with Taylor, Bean & Whitaker in 2008.My husbands income was reduced before our first payment was even due. When we called TB&W they told us that they couldn't do anything for us unless we were at least a couple of months behind. When we did get a couple of months behind they made it very hard to work with them. They are very hard to get in touch with and you have to spend at least an hour or more on hold before you get in touch with someone that acts like you are wasting their time.

We did make a regular payment in October 2008 but were told after that payment we were not allowed to make a regular monthly payment. We had to pay everything that was past due in full or no payment at all. The informed us that a regular payment would be sent back to us.
In November 2008 we agreed to a repayment plan with TB&W and we agreed to pay them a certain amount. We sent them the agreed amount and less than 2 weeks later (now into December 2008) they called us back wanting more money. We were told that there was a mistake made when the repayment plan was set up and if we didn't give them more money they would void the repayment plan and we wouldn't be eligible for another one. We didn't have the money as my husband only gets paid every 2 weeks and we had just paid them the agreed amount less than 2 weeks before. They voided the repayment plan and told us that we were not allowed to send in any payments unless it was for the full amount that was past due and we weren't eligible for another repayment plan.

In December 2008 I contacted HopeNow and a rep called into TB&W with me. We got nowhere. The TB&W customer service rep didn't want to answer any of my questions and the counselor from HopeNow wasn't even given a chance to talk beyond saying who she was and who she was with. We were told by the customer service rep for TB&W less than 10 minutes into the call that our time was up and she litterally hung up on us.

In December 2008 I also contacted a "for profit" Modification Specialist and after fighting with TB&W for over an hour about granting permission for this company to call them was successful in letting the Modification Specialist talk to TB&W on my behalf. The Modification Specialist called me back the next day and told me that TB&W was willing to modify my loan and that I needed to call TB&W and they would tell me what info they needed from me. Upon calling TB&W I was told that there would not be a modification on our loan, however there were notes on the account about an approved modification. Luckily I did not pay any money to the "for profit" Modification Specialist.

On January 22nd 2009 I called yet again to see what our options were and spoke with a lady that seemed sympathetic and promised to help us. I mentioned the last situation with the repayment plan that was cancelled and told her that we were told we didn't qualify for another. She didn't confirm or deny that, she just had me fax her our "hardship paperwork" and said that she knew someone in Loss Mitigation that she would talk to to get our case handled quickly since we were gettng close to Foreclosure. She said that she was submitting our "hardship paperwork" for the purpose of an FHA Partial Claim. She claimed to take the paperwork to her "friend" in Loss Mitigation and her "friend" told her that we qualified for the FHA Partial Claim. She advised me to call her every day to every other day to check on the progress of our "hardship case". She stated that the foreclosure could be stalled while we were waiting for a Negotiator to be assigned if it got that close. She said everything to put my mind at ease. If only she hadn't been lying.

I called this woman's direct number every other day (sometimes every day) for around 4 to 5 weeks. She didn't inform me until the 5th week that it would take 6 weeks for a Negotiator to be assigned. She then told me to start checking back with her once a week.

After calling her number and getting voice mail and leaving messages with no return calls I called the Loss Mitigation number on our monthly statement on February 25th 2009. I got a customer service rep that couldn't tell me anything so I asked for her Supervisor. The Supervisor informed me that my "hardship paperwork" hadn't been assigned to anyone because it hadn't been processed correctly. She stated that she would process it correctly and see that it got to a Negotiator. She called me back the next day with the name of the Negotiator it was assigned to and told me there was no direct number to reach the Negotiator. I've called the Customer Service number and asked to be transferred to the Negotiator but only get a voice mail, which I have left message on and to this day (May 6th 2009) have never received a call from the Negotiator.

On March 26th 2009 I called TB&W yet again to enquire about our "hardship papers" and FHA Partial Claim status. I was informed that as of March 20th 2009 we were considered to be in Foreclosure. When I started explaining my situation to this customer service rep she transferred me to the lady I spoke to on January 22nd (who didn't process them correctly and didn't return calls) without any notice at all. Her attitude towards me completely changed that day and she was very nasty with me. She stated that she offered us alternatives back in January to help us get caught up...which she never did. She also stated that she informed me on January 22nd that it could possibly take 12 weeks for me to get a call from the Negotiator, which she never did. If she had then why did she encourage me to call her every day to every other day?

When I started getting very angry and telling her that she never informed us of any of these things she then stated that she could set up a repayment plan to make sure that the Foreclosure wasn't filed. I asked her why it was being offered now when I wasn't eligible for one and she informed me that we had always been eligible for a repayment plan. If we had always been eligible then why wasn't it offered? She said she offered us a repayment plan on January 22nd, which she did not. We would have jumped on a repayment plan then.

She said she would have to call the Attorney in my state that was assigned to it to get the fees so she could add them on to the repayment plan. She also stated that she would let them know that the Foreclosure was to be halted since we were agreeing to a repayment plan.
She sent is the repayment plan paperwork.On March 30th 2009 we signed the repayment plan paperwork and sent the paperwork along with a cashiers check for $1200 to the attention of whom I was told via USPS next day delivery, signature required. I called her back the day I sent it off to let her know that I next day mail.
It was to be delivered on March 31 by 3:00 p.m.

On April 3rd we received papers from the Attorney assigned to the case that we were in Foreclosure. I called them and told them that I had made arrangements with TB&W and that on March 26th they should have received a call from the lady that I made the repayment plan with to let them know that the Foreclosure should be halted. I was informed by the Attorney that indeed she did call but only asked for the amount in fees that were owed and did not ask for the Foreclosure to be halted. The Attorney informed me that it must just be a mix up and she would probably be getting a call from the lady at TB&W that day or the next to have it halted. I did try to get in touch with the lady at TB&W but my call was not returned.

On April 7th the Foreclosure was filed in our local court and we were served with Foreclosure papers by 2 local Deputies. It had literally just been filed that day.

My husband called TB&W and was told that our repayment plan was still in pending status and our paperwork and cashiers check were not on file. He did confirm that the paperwork and cashiers check had been delivered but said he did not know why it hadn't posted to our account.
On April 8th I called TB&W to inquire about the whereabouts of our paperwork and cashiers check and to figure out why we had been Forclosed on after coming to an agreement with TB&W. The customer service rep could not find any information on our paperwork or cashiers check and stated that our repayment plan still being in the pending process was odd. She stated that the Foreclosure should have been halted the day we made the arrangement and the repayment plan should never have been placed in pending status. She also acknowledged several issues with our account that she thought was odd. I still didn't get anywhere with her as she couldn't even confirm that the paperwork and cashiers check had been delivered to them.

April 14th 2009 I finally got in touch with someone from TB&W. Still no confirmation of delivery. The customer service rep was very rude and told me that the missing paperwork and cashiers check was my problem. As soon as I got off the phone with her my husband had printed out the delivery confirmation from the USPS website. It had indeed been delivered and signed for by a TB&W employee on March 31st at 12:30 p.m.

I called back that night to confirm it with the TB&W customer service rep to no avail. I was again told that it wasn't there and they didn't know where it was.
I called TB&W on April 15th 2009 and talked to the same lady I had talked to on April 8th 2009. She remembered what happened but still had no news for me. I emailed her the delivery confirmation from the USPS website and she took the name of the person that signed for it and confirmed that the person was indeed a TB&W employee. She said she would ask her Supervisor if she could fix our account for us, but apparently he said no because nothing has been fixed.

I have emailed her several times asking for updates because it's so hard to get in touch with anyone by phone and her replies to my questions don't make any sense. She doesn't answer my questions...just says the same thing every time that doesn't have anything to do with my situation.

In the mean time my husband and I had to hire an attorney to get the Forcelosure extended...which was granted until the end of this month, which we never should have had to do. We never should have even been Foreclosed on either.

I called TB&W on May 4th to again inquire about our paperwork and cashiers check. The customer service rep finally answered after 1 hour and 25 minutes on hold and confirmed that our paperwork and cashiers check had indeed been delivered to them and gave me the names of 2 women that our paperwork and cashiers check were in the hands of physically and one woman claims to have delivered it personally to the woman it was addressed to but the woman it was addressed to claims she doesn't have it and doesn't know where it is. He also informed me that there was a note on our account that a lady from TB&W called us to inform us to put a stop payment on the cashiers check. I have received no phone calls from anyone at TB&W since February 26th 2009. I have caller id and voice mail. I wouldn't have missed the call. I can't put a stop payment on the cashiers check until 90 days have passed since it's purchase. It's been 37 days. He admitted to feeling like he was being put on the spot and didn't have any suggestions for me. Another 2 hours of my life wasted.

On May 4th 2009 I received a call from the woman that our paperwork and cashiers check was addressed to. She confirmed that nobody knew where our paperwork or cashiers check was. She also confirmed a few other things for me. She stated that our Foreclosure should have been halted on the day we made the agreement. She had no explanation as to why it had not been halted. She also stated that we had been wasting our time waiting these last 3 1/2 months for any information on the FHA Partial Claim because in order to qualify you have to go through a Forbearance and make 3 regular monthly payments. She also stated that there was no guarentee that we would even qualify for the FHA Partial Claim after the Forbearance because we would have to submit our "hardship" paperwork and wait all over again. It's been 16 weeks since we sent in our orginal "hardship" paperwork without a word on it.

So essentially.....we started out 3 months behind when we were denied a new payment arrangement (which we would have only had to make up 2 payments because we would have put down the amount of one payment as a downpayment on the repayment plan) because of TB&W's mistake...and now we are 7 months behind and being Foreclosed on because they have strung us along with lies and mistakes.
Now they are saying doing a Forbearance is the only thing that will get us out of Foreclosure, but after the Forbearance (3 regular monthly payments) we will still be 7 months behind. We would be expected to either pay the full amount past due or set up a new repayment plan (which won't be guarentied to us) within 11 days of the end of the Forbearance. Exactly how does that help us? To me it's just another way of stringing us along and forcing us back into the situation we have been in for 7 hellish months.

I want to know why I'm being made to pay for TB&W's mistakes and inability to conduct business in a "business" like manner? I will admit that it is our own fault for getting behind in the first place, but their mistakes and lies have caused us to get even further behind.
