I was rear-ended about two months ago. A police report was filed and I waited for the insurance to call. When I heard nothing I called...twice, with no response. I finally got through and gave the requisite information and took the car for in an estimate. Yesterday I received a letter from the claims department that the matter remains unresolved because the "insured had not yet reported the accident". Today I received a phone call from the adjuster he stated that the insurance company would not have to pay the claim if the insured did not report the accident. The adjuster was extremely rude and condescending. I explained that the other driver sustained no damage to her car and was likely not going to call in. His response was that I had no right to make any assumptions about the other driver. My assumptions were based on the fact that the driver had not called in yet...two months after the accident. When I asked him why he was being so rude, he said because I was making assumptions. He then continued to quote a law that stated that Unique Insurance was protected from paying out claims when the insured did not call it in...even if it was their fault. End of story. No recourse for me. No payout from them. I tried to verify this so called law...not true. I tried calling back and no one answered any of the lines.

No insurance company is going to pay a claim until they have heard from their insured. That doesn't mean you're out of luck. Here's how it works.
The person responsible for the loss is the other driver (assuming she is really at fault). She has an insurance policy that will cover her liabilities, but her contract with the insurance company says that only happens if she cooperates with the company. If she refuses to talk to the insurance company, the company will not pay out on her behalf.
You're probably going to have to file suit against the other driver in order to get this moving. If this is a non-injury accident with not a huge amount of damage (sounds like it, since she had no damage), you should file in small claims. It's a small filing fee (reimbursed if you win) and no lawyer is required.
