I am a single, disabled 42 year old woman. I have been disabled from a brain malformation since January of 2005. It is impossible for me to work and have lost my health insurance.

I have so many medical debts in collection it isn't funny. I have talked to numerous third party debt collection agencies. Most have been very understanding. That is, until I recieved a call onmy answering machine from a man named "Jim".

He gave a number for me to call back, a reference number, and then told me the call was about a lawsuit being filed against me and he needed to talk to me about it, his voice dropping to almost a whisper.

Needless to say, I was scared out of my mind. All I could think of was "this is all I need now, along with everything else going on" I have lost practically everything I own. I have had to go to missions for food and clothing. I have endured countless humiliations and embarassments.

I did'nt call Jim back all week. I waited until the following Saturday. That is when I found out "Jim" was a debt collector, not a attorney or even a law office. Then I found the letter I had recieved from United Collection Bureau that was generated the exact same day that Jim left me that terrible message, and had the same reference number on it. I have the voice message on tape now.

I called the Attorney office I was directed to also and was informed by the manager that my accounts are not in thier office and have not been since June of 2005, when it was decided by the attorney that they were not going to file against me. They sent my accounts back to UCB in June. A UCB supervisor tried to convince me that was not correct. I told her to call thier attorney and get the right information.

The fact is, the debt collector had no right to leave personal information on a machine. They cannot imply that they are calling from a legal office. They cannot say they are filing a lawsuit against you. They cannot harrass, abuse or threaten you. I am filing my own suit against UCB inc. People need to know that this company has over 180 complaints against them (posted on the Ohio Attorney General website)

I got a letter from the better business bureau, stating that since there was no evidence of wrongdoing, that the case was CLOSED> hmmm i wonder how they think a tape recording of the collection call can be considered "no evidence".

They went on to say that "JIM" has been corrected and would have to take training classes. If Jim didnt do anything wrong, then why send him to more training classes??? They also asked me to send them the tape. Why, so they can get rid of it? I dont think so. UCB gets away with lying to people, saying that they are lawyers or that they are suing you when they have no intention of doing so. I do have in writing however that UCB is to never contact me again. If nothing else gets done about JIM scaring the bejesus out of me, I have the satisfaction of knowing I will never have to deal with them again. Now, if they contact me again, after agreeing to cease and desist, that is another matter.

You will need to record everything from this point on, whether taping is legal or not in your state won't matter, a lawyer will find a way to use it.If you get another call, get him to repeat all of what he said before,if you can, and create a legible, dated file that a judge can follow. Let him incriminate himself as many times as he wants to and use the tapes to clear yourself, and maybe get a judgement in your favor too. Of course the collection agency will say "Jim" has been fired, but you'll have them by the balls anyways. Extortion, phone harassment, and terroristic threatening comes to mind. But you WILL need evidence. And if the cops do get involved, make sure you get a receipt for whatever you give them so the dummies don't lose it. Your current finacial staus won't matter either, so don't worry about it, just go to war against this clown.
