I called my bank Wachovia and wanted to make sure I could make a deposit into the ATM and get cash back.

I was told yes and I was never advised of any cut off time.

I went to the bank deposited a check for $95.00 and already had a balance of 38.00. After the deposit I took out $120.00. A refund from another company also came into my account the same day for $21. And change.

The next morning there were 420.00 in overdraft fees. When I asked Wachovia what happened they told me I made a deposit after the cut off time in the ATM. They also went on to say that it is clearly marked at the ATM the cut off times.

Here are photos of the ATM and audio recordings of their customer service department failing to disclose this information.

The went on further to say that because I did not take care of the $420. Overdraft that the next day that resulted in another $175. In fees for a total of $595. In fees that they expected me to pay.

I contacted the VP of banking for FL and she did not call me back for 9 days, when she did she was extremely rude and unhelpful. After getting off the phone with her I felt like I had some other concerns that I did not get addressed so I called back and never received any call back from her and had to contact the office of the President of Wachovia bank.

Since then they have refunded all but the $175. Saying that I am still responsible for that. If they refund all of their unjust fees into my account I still have a positive balance.

They even went as far as to accuse me of not keeping a check register and told me that I had overdrafts in the past as to shame me or something in the letter.

This is the worst bank I have ever dealt with in my life do not bank with Wachovia bank.

Cutoff times

The cutoff times are posted on the side of ALL wachovia atms AND, when you insert your card It will state : any deposits made after 4pm will not be credited until the next business day. If you make a deposit in the branch it prints on the bottom the EFFECTIVE day of the deposit AND In each teller window, it tells what time the cutoff time is. DID You ask what the cutoff time was?

That that State of Florida is what is known as a "two party" state, in that BOTH parties must have concent to be recorded. If you record someone without their knowledge or concent you have commited a crime and can be prosecuted. This is especially important if you did post it on a PUBLIC web site. The actual law is too long to post here but you can look up Florida Statute "934.03 Interception and disclosure of wire, oral, or electronic communications prohibited"

I did not listen to the recordings or pictures. However, when you called it all depends on how you ask. Your first like stated that you called them to make sure you could make a deposit and get cash back. Did YOU ask about any cut-off times?

As to the rest of your report I believe you are leaving things out. First of all after the deposit and refund you would figure you had $154 according to your numbers. You took out $120 leaving what you would think would be $34. Now, out of that $34 you had $420 in OD fees, that is about 12 Overdrafts. So are you saying you made 12 transactions with less than $34 in your account and still had enough in your "records" to stay positive? Not only that but to have another 5 Debits the next day? If so that means that your average transaction was about $2.

If this is truly what you did the first thing I would make sure is that you are keeping your own register. The next thing is to cut up your debit card for these small purchases. Take out cash and use that instead. You may still OD if you take too much out, but at least it would only be one fee instead of the many fees for these small transactions.
