I went up to the customer service desk at Wal-Mart on 441 in Apopka to return a Geisha video tape and three bags of Jack Daniels wood chips, all of which I purchased on April 14, 2006. The Wal-Mart cashier at the customer service desk (whose name I believe is Cathy) removed the pink stickers, which had been placed on the items by the door greeter when I entered the store. She told me she would issue a credit, because I did not have my receipt.

The cashier then communicated with another Wal-Mart employee (who was later identified as Loss Prevention), after which the cashier told me that she could not return the items. I asked why, and she informed me that she was instructed not to take them, because she was told they are stolen.

I was shocked and asked her who told her that they are stolen? She was then joined by Loss Prevention (a Caucasian woman, whose name I believe is Melissa) who said: you did not bring these items into the store when you entered they are stolen.

During this incident, there were numerous other customers and employees in the customer service area and at checkouts nearby who observed this humiliating experience. Some of these customers could have been people I know. I was shocked, embarrassed and hurt by this very public, wrongful accusation.

Loss Prevention took my identification, and I waited for the police to arrive. During the course of this event, I indicated to Loss Prevention and the Co-Manager (Ron) on numerous occasions that I walked into the store with the items (evidenced by the pink stickers affixed to them by the door greeter). Loss prevention said they researched my movements while in the store, and declared I did not bring the items into the store. All the research that would have been needed was to ask the door greeter (or Customer Service Manager, Desiree, who was standing next to the door greeter when I entered Wal-Mart).

I asked Loss Prevention and the Co-Manager to go and ask the door greeter if I walked into the store with the items, and they did not. I was detained for more than an hour in high visibility in the front of the customer service area until the Apopka Police arrived (Officer Robert Bruce).

Shortly thereafter, the Co-Manager, who initially participated with Loss Prevention, informed me (without explanation) that I could in fact return the items. However, what could not be returned by this time was my dignity and sense of well being owing to this false detention and public humiliation. I felt badly violated by Wal-Mart and obviously targeted.

I entered the store with a friend, Andrew Collins (we rode together to WalMart), who is a Caucasian male, and no research was done of him by Wal-Mart. He was essentially invisible, even though we entered Wal-Mart side-by-side. He was never questioned or approached at any time by any Wal-Mart employee, despite the fact that we remained together while inside of Wal-Mart, except for the short period we separated when I went to Customer Service. He was in as much shock and disbelief as I was about the false accusation. His immediate reaction was you would not have accused me of this, because I am white.

The door greeter and CSM Desiree told me that no one from Loss Prevention ever approached them to inquire into my statements about entering the store with the items. It is apparent, this whole episode manifested out of prejudice and a fixation on me. This incident never should have happened.

I feel very violated by Wal-Mart's inexcusable and degrading actions. I was falsely accused, wrongfully detained, and defamed in front of numerous customers and employees without even an apology from Loss Prevention.

I did not deserve to be subjected to this public humiliation, psychological trauma, and physical stress. I am a service-connected, permanently and totally disabled veteran with a medical condition that is exacerbated by trauma and stress, and this vicious assault by Wal-Mart has had a negative impact on my condition. I am not a common thief, and I deplore Wal-Mart for suchlike treatment. What Wal-Mart did to me is unforgivable. What is more, if this can happen to me, it can happen to anyone.

Something must be done to stop Wal-Mart's immoral, predatory practices and reprehensible behavior.

i dont know how it is in your area, but in texas you get targeted for being white in walmart. they treat you like crap if your not black or mexican. so dont say walmarts racist. its ll demographic

some of you are being racist, and one of you so called ex employees of loss prevention are giving false information!

I am an ex Loss Prevention Associate.

Loss prevention does not go by race, age, the way your are dressed, or any judging the book by it's cover.

LP's are trained to examine every single customer they see... details matter...you can tell by nervousness, they way people move, the area they are in, the merchandise they have, etc.. all of this is taken..

i would think within 90 days, a return could be made, with store credit w/o receipt.

however!!!!!!! asking a door greeter, or a csm if the person came in with a receipt is not a valid response on behalf of loss prevention or management.

loss prevention has the right to research this, but only by checking the door cameras that will provide proof if the customer came in with the merchandise.

this store location needs to be retrained!

You claim you purchased the stuff in April 2006. In January 2007, you claim you tried to return the stuff.

Sure. I can't imagine why people doubt your story.

i worked loss prevention at wal-mart, and i have experienced this EXACT SAME THING. wal-mart has a policy that tells its loss-prevention officers to target people who look "young, Financialy challenged(poor), anybody wearing baggy clothes, or carrying large purses"

i FIRMLY believe you did not steal anything because some of the loss prevention team members i worked with would monitor almost any african-american customer they could, granted most of the time, it was young males and the kind of kids who look like they might cause trouble (that includes caucasian teenagers) and on many occasians there would be a scenario when they could not tell if an individual was stealing so what they would do is wait for the individual to walk out of the camera view and have an associate say they seen them pocketing merchandise.

i believe you were discriminated against and i believe that you should persue a lawsuite. a great way you could go about winning a lawsuite is getting the greeter from that day testify in court. they cant do anything about an employee testifying against them either because its against the law for them to do so. you may also be able to sue for public defamation of character and emotional distress, along with racial discrimination, and wrongful accusation of a felony

im very sorry to hear this, and i hope wal-mart gets what they diserve

You don't mention your race, just hint at it by using names normally used by the Black community, Desiree. The manager reimbursed you the approximately $35 because the video camera didn't catch you pilferring the items, thus Loss prevention could not prove you shop lifted, went outside and came back in, which is what you probably did.

Let me guess, your disability is service connected Post Traumatic Stress, brought on by too much ingestion of LSD in Nam, or was it hashish?

you are so strong in your belief that you bought the items on April 14, 2006, how is it you know the date so well? Your check balance book says you bought something at Walmart that day?
Sounds almost like you are trying to garner support for a racial profiling suit, but in reality you got away with theft after almost being caught.

Walmart sucks

I don't doubt that there is a possibility of racism in the actions of the manager and loss prevention, however I think it's unlikely. I wasn't there so of course I wouldn't know for sure, but it seems to me that Walmart would be kind of paranoid about doing something that looked even remotely motivated by race.

What I think they're actually guilty of in this situation is extremely poor customer service and staggeringly unprofessional behavior. Based on my own experiences at Walmart, I wouldn't put this past them at all.

I've never returned anything at Walmart, though sometimes I'm tempted to, but I know that if I had to return something I'd be standing in a line for a couple of hours. It isn't worth it to me, so I just eat the loss. Not everyone is willing to do this, however, hence they encounter poorly-trained, poorly-dispositioned (perhaps because they're poorly paid) workers.

I think you should consider sueing these people, however I think you might weaken your case if you persist in bringing up race, as this allegation is unproveable and regardless was initially brought up by you and your associate. If you stick to unassailable facts, such as the fact that you indeed had your items at the time of your entrance to the store, and the fact that you were wrongfully and humiliatingly (and persistently) accused of outright theft, I think you could win yourself a nice little settlement based on emotional distress (you can't nail them for false arrest as there were no police), or at least a nice gift certificate. At the very least, a person in a high position up the Walmart chain of command should issue you an apology and an assurance that those who hurt you will be given consequences for their behavior.

On another note, though, I don't really know why you'd want to return stuff to Walmart eight months after you bought the items, without a receipt.
