Wells Fargo allowed auto charges to my account, when looking at my account online for the specific dates, the money to cover them was not available and then continued to allow more charges.

If I was to go to a store and swipe my card and the account was short of the amount being charged, the sale would have been declined. They have allowed services such as compuserve and my gym to charge my account.

They also allowed me to take money from my ATM the same day that a charge was made that put my card over the limit so this scam of holding funds for a certain period of time then releasing them is not true. I myself am not a great accountant, I do expect my bank to be, that is why I pay them the charges to have the account. I did not give Wells Fargo the authority to allow for a charge if the money was not there and then screw me for the service.

It is a scam and they know it- We need to file a Class Action lawsuit to stop these sharks from practicing banking the way they have been. They are not a bank, they are a huge institution that is robbing us.

As for the bigshot teller that added her two cents worth, I am embarrassed for you. I wouldn't ever let on to anyone you know how cool you really think you are.

Down with Wells Fargo!!! :)

Alright!! We are on to something!! We all know Wells Fargo bank is crooked... I agree with the old saying "Safety and strength in numbers." Everyone complains about this evil institution, but nothing ever comes of it. Shawn, please follow through with your complaint to the Comptroller and continue your pursuit for justice. I am tired of hearing I will get screwed by the system forever because "This is how it works." "The rich triumph over the poor and middle class." Where was this stated in the Constitution? Pitiful, it really is. Our country was founded on truth, sacrifice and justice. Why should a dishonest, thieving institution (Wells Fargo) be allowed to continue ripping off hard working people???? This is an injustice and an insult to our nations founding fathers. Again, I cannot stop this deceit without others. Please help me stop Wells Fargo from hurting and stealing from others...... Tami

This is the response I received from Wells when I Emailed them of my dispute.

Take note to how they (may) pay charges. It looks as if they do it however the mood strikes them. They pay from high to low- this way they can charge more fees. Thanks for the info on the Comptroller, I am going to contact them.

I cut and pasted this letter:

If you perform an ATM or POS transaction without sufficient funds in your account to cover the transaction, we may:

- Cover the transaction if you have overdraft protection
- Pay the transaction and create an overdraft in your account
- Decline the transaction.

If we authorize the transaction, you may be charged a fee, which will vary depending upon the action taken.

The "Order of Posting" is the method we use to determine the order to pay items. The Order of Posting helps determine which items may cause an account to overdraw, triggering a fee and the possibility of a returned check.

The following items receive priority:

Credits
Fees
Previous day's work- Items with an "as of" date.
Cash withdrawals

The Order of Posting method for your state is High to Low. This means that items are reviewed and paid by highest dollar amount to lowest dollar amount, regardless of item type (electronic, non-serial numbered, checks). ATM & POS transactions cannot be returned.

The different "orders of posting" vary by state. The method we chose in each state depends on state laws and the methods our competitors use. Thats why we state in our "deposit account agreement" that Wells Fargo determines the order of posting unless otherwise required by law."

case against Wells Fargo

I have recently written to the Comptroller of the Currency (yes it is Comptroller, weird, I know). They have opened up a case against Wells Fargo in regards to the information and evidence I have sent them. The address is Comptroller of the Currency, Administrator of National Banks

Houston, Texas 77010-9050. If we are going to stop this criminal activity, we need to stick together and I am willing to go the whole way!!! This must stop!!
