Tuesday, October 24, 2017, Wells Fargo Bank emptied my bank account to $0.00 to a creditor. They called this a Legal Order ACH Debit to a creditor - a Chicago law firm. The law firm was hired on behalf of a prior landlord who wrongfully evicted us because he failed to make repairs to major plumbing issues. he was cited several code citations by the Building Code Enforcer. I had to get the Village of Westchester, IL involved because the landlord refused to fix sewer water back-up in the kitchen sink. Instead of making repairs, this landlord harassed me and my child. He wrote me several threatening and harassing emails and text messages, and posted lease termination letters on the front door of the apartment a few days after the building inspector came out. He threatens not to release and that he was planning to evict us. This landlord is a real slumlord!!!  All he wants is your rent on the 1st of the month. He will not make any repairs or maintain the cleanliness of the property.  He has real mental issues as if he is bi-polar. He has a terrible temper and yells and tries to fight. He makes up lies to evict us. The landlord is so cheap that he stopped garbage pick up to only 2 times a month, which caused a lot of garbage on the ground, flies and rats.  He put large spiders and crickets in our vents to bite us. I took pictures for proof. What a sick person! Now he ran and hired some low down dirty law firm to do his dirty work to rob us by taking money straight out of my bank account.  I paid this landlord rent with a personal check from Wells Fargo. He kept my account number. Then he gave my bank account number to this dirty law firm to illegally take my money. This dirty lawyer sent a sheriff with a summons to Wells Fargo with a legal order to garnish every penny that I had from my bank account. Wells Fargo gave them the rest of my money that was in my bank account without even notifying me. What kind of bank this? What Wells Fargo Bank did is wrong and illegal. I put my money into this bank because I thought my money was safe. I trusted this bank! I just cannot believe what Wells Fargo did!!!  

This is illegal activity! I will personally sue Wells Fargo Bank and this creditor and law firm for robbing me! They stole my money right out of my bank account and left me with $0.00!!! I was at the grocery store buying food for me and my child and when it was time to pay, the cashier said my card declined! I was like, what the hell! That's impossible! While standing there I checked my bank account online and below is what I saw:

Not to mention that this was the only funds in my account at the time. Wells Fargo did not care. They just went into my bank account and ACH debited my account giving the rest of my money to some low-down dirty lawyer and creditor who sent a legal order to this bank.

Wells Fargo, I am demanding my money back into my account immediately! I will sue Wells Fargo Bank for illegal ACH Debt transactions in which you stole my money from my account! I want consumers to be aware of what Wells Fargo Bank is doing so that this never ever happens to anyone else.

Wells Fargo Bank allowed and accepted creditors to garnished all of my money out of my bank account without even notifying me, or giving me a chance to contact the creditor to work something out, which has to be breaking some sort of laws in the financial industry.  I am demanding answers from this bank, and I am demanding all of my money back immediately! I plan to sue Wells Fargo and file a class-action lawsuit for illegal ACH debit transactions.  It is in your best interest to contact me and fix this mess that you have made!

It doesn't matter if you think the Court Order was valid or not. If a bank is presented with an attachment order they MUST execute it or they will find themselves in some serious trouble for ignoring the courts.

They will also NOT contact the account holder for the obvious reason. As the first thing the account holder would have done is empty the account, making the entire attachment basically worthless.

You can sue Wells Fargo if you want, but it won't go anywhere and you will just be waisting more money. If you want to take any action it needs to be against the actual Court order and your Ex-Landlord.

However, the history of this case is important. Before the courts issue an attachment you would have had to have been sued and lost by your ex-landlord.  If you went to court on that, had a chance to defend yourself and lost then you have pretty much no where to go.  Now, if you are going to say that you had no idea of the original suit. You MAY never have been properly served. In this case you can attempt to get the judgement vacated, which would (at least temporarily) return your money. For this I would highly suggest contacting an attorney.

One final item, based on the amount they took, realize that once an order is in place it is not a one time attachment, it is valid for a certain amount.  So you have to consider that account "dead" as any money that goes in will most likely be immediatly captured because of the order.  While I doubt you would do this, it would also apply to any account at the same bank.  So if you want to open up another account it needs to be at a different bank, and just hope that this law firm doesn't find out your new bank.
