If you are trying to get a loan modification, refinance or short sale out of Wells Fargo, beware. They have a culture of deny, delay and misinformation which is scripted for the reps to read. you have options.
We have spent 13 months trying to get a HAMP mod. for our house. WF has more than 2 years of financial information. Twice they put us into trial payments; both times they cancelled them with no written communication.
The house is in short-sale with a viable offer, pre-qualified buyer and I have received 7 certified letters this week saying the house is going to foreclosure. The important information comes slow regular mail after the scarey stuff.
If you are facing refinance under HARP or modification under HAMP, or short-sale, do the following:
1. Get the name and identifying badge number of everyone you speak to at WF everytime you call.
2. Keep a notebook of every date and time you call and the person you talked to and Get the person's fax number as well.
3. After each phone call, fax what is called a 'QUALIFIED WRITTEN REQUEST' to wF's department you just talked to. Site the RESPA act, found at www.hud.gov, or google RESPA+Qualified written request and it will give you the website and the law protecting the consumer. You are REPEATING back to WF exactly what you were told, on that day, by that person, with that person's ID number and what they have asked of you.
WF must respond to your QUALIFIED WRITTEN REQUEST every time you send one, within 30 days and give you confirmation of the information you are repeating back to them within 60 days.
You do this because they basically lie to you.
4. Find a not-for-profit consumer credit counselling group, approved by HUD and a member of the CCC. They will help you manage your debt in a debt management plan for all unsecured debt which will free up some of your money.
5. Contact the HOPE hotline or the Home preservation foundation and they will put you in contact with someone who can help you.THERE SHOULD BE NO FEE ATTACHED TO THE HELP.
6. There are short-sale specialists you want to use if you are selling your house, not just any old realtor. Ask for the specialist in a realty office; if they don't have one, call somebody else
7. Keep a copy of everything you mail or fax to WF--they have a way of losing documents.
8. You can send a cease and desist letter to WF if you want the annoying phone calls to stop. They must contact you only by mail after that. You may continue to call them.
9. Call weekly to check on progress of your file; most of the time they say--"It's with the negotiators" to which you have no contact.
10. File a complaint with the government office called the Office of the Controller of the Currency, a department of the Treasury which oversees banks,www.occ.gov or google 'office of the controller of the currency'. Nothing will get done until enough people complain to this office. There is an on-line form or you can print it out and fax or mail it.
11. When WF calls you asking for 'additional information', don't answer anything over the phone. Tell them you will make a list of their questions, or list of the information they want, and compile it and fax or mail it to them. They are trying to TRAP you over the phone in the seemingly simple questions they are asking. Make a list; make an excuse that you have to go, or your spouse is out of town and they have the information, or you have to speak to your accountant or attorney first before responding--they don't know if you have an attorney or an accountant.
Before signing ANYTHING from WF, take it to an attorney or legal aid. Many of their documents are prepared incorrectly, have hidden terms, have incorrect money you owe, etc.
List the state in which you live when you file a complaint on line or here. The more cases in a state, the more likely a class-action attorney will pick it up
