We bought our home Aug.2005, summer of 2006, we got behind. We put in for a forebearance. They refused to accept any payments while they were deciding to grant us the forebearance, it took them until Sept 06, 2 days before the sale of our house, to decide they would grant it. So that put us farther behind. Our Payment went from 1185.00 to 1500.00 from Sept-Mar., and according to them, we still would not be caught up. We were 5500.00 behind and have paid 7500.00 since Sept, but according to them we still owe 9300.00. Late fees, lawyers fees, and appraisal fees. 2000.00 just to file laywer paper work! I want to know how they appraised it from Oregon, I never saw anyone here taking pics! This company has done nothing but find ways to keep adding more $ to our house and I will be finding a lawyer, anyone else care to join us?

not sure what to say about it taking a year to reply but if you are still so sure you are correct I would think you would have contacted an attorney already and since I do not see that here my only guess is you are angry and that is fine things are tough for everyone out there. Even more than before. Did you ever get the help you needed?

Wilshire does NOT try to work with everyone, and they most certainly will refuse a payment regardless of payment history. My grandmother paid her mortgage every month 15 days EARLY!! They will not work with her at all. They said that she makes enough money but just has too much debt. They even said that she needs to sell her vehicle and get a cheaper one. The FHA states that a loan should not be more than 32% of your income. Her is over 45%. And it was scheduled to go up again. SO Wilshire does nothing but lie, even on here. I realize that it is your job to go to bat for them, but you shouldn't jump to the conclusion that your company is doing the right thing. I have nothing but bad experiences with this company. Read your contract isn't an appropriate response. All of the employees need to go take a Humanitarian class. There is obviously a moral and ethical problem with this company to be having so many employee suicides, mental breakdowns, etc. I can prove everything Wilshire has EVER said to me on behalf of her or her herself. I have written material, proof of reciept with signature confirmation. How can you justify that, or does my contract have a "We can lie" clause in somewhere that I don't know about. Oh I as well have a mortgage with Wilshire that was bought from another company. But I am working on getting it refinanced so that I don't have to deal with them ever again. They are the biggest Predators out there, and I share this with people daily.

I respectively disagree with both of you. Wilshire helps everyone who is having a hardship and to say that we would not work with you is just a flat out lie. If that was the case we would not have a loss mitigation department to help customers who have fallen behind we would just simply let the home go in foreclosure and that would be that. The fees that you are charged are in your contract that you signed. Wilshire is a servicer and what that means is we abide by the terms of the contract that was signed and it says you are responsible for fees.

When you pay outside your grace which is normally either a 10 or 15 day you are charged a late fee which is set by the state and is normally 2-5% of the payment amount. When you dont respond to letters or phone calls after a while we order a property inspection to make sure a person is still living in the home. When a notice of intent is sent out after 35 days of delinquency we order a bpo which is a appraisal on your home. We dont come and knock on your door and tell you we are there to do an inspection instead we drive by take pictures of the outside of the house and compare how much houses in the same area are going for. The reason we do that is that if the home goes into foreclosure we then know what the fair market value is on the home. All these fees add up it is true but they are part of your contract.

If you are really looking to go after a company who is breaking the law and hurting customers why dont you check out the article in usa today from june 26th 2008 the headline is usa today homeowners fight for their mortgage rights lawsuits target loan servicers billing practices. Guess what Wilshire is not mentioned in the article so if we are really doing things wrong we would have been shut down a long time ago.

One last thing that I want to point out...Several mortgage servicers have went out of business due to the mortgage industry crisis, Wilshire is still around if we were not doing a good job and passing quality inspections we would have been closed a long time ago. We are so heavily monitored the ftc can listen to any calls at any time.
We have to pass the moody's test as well.

The truth is we are happy to help people who are having a hardship. I know first hand that these are hard times. I think that is why it upsets me so much when people talk down at us and imply we are not there to help.

Finally, we do have a legal department and we do use attorney's and yes a customer is charged legal fees which is in the contract that was signed, attorney's are not free.

Wilshire's Deja Vu

This is the same thing Wilshire has done to me and iis doing to everyone else.
Please rest assured that they will get their just dues. I anxiously wait for the day this company is on television because the feds came in and it will happen. Whateever happens keep any and all papers they send you and whenever you talk to them "Record it". Tell them this call is being recorded but record it. When a paper is mailed to you full of predatory lending violations, as mine was, there is not really much they can fight about. Also they claim they work with HUD but that won't be too much longer. I am in touch with HUD and am supplying them a lot of information this company has done. This is a bad, bad company!!

They send rebuttals saying the extra balance is for attorneys fees. What attorneys? That is a laugh. There is paper with an attorney name on top. I have never spoke with nor know, as my attorney, of an attorney with that name so I don't believe the attorney BS. That is another way of a person on the other end along with Wilshire to get yours and my money. Aftrer all we never asked for a foreclosure to happen. We tried to prevent it but this company wouldn't work with us. They wouldn't work with us because they made more money by not working with us. Legal fees are ridiculous. They would never give me a breakdown opf legal feew and if they have an attorney they should. Besides that it's the fault of Wilshire that they are legal fees in the first place.

I have done extensive background checking on this company and there is very little that I do not know about them. This company is not playing with a full deck. Attorney fees are BS!! Legal fees are BS! Appraisal fees are BS! These people are milking and scamming every penny they can get for as long as they can. They would have to be an absolute idiot not to know they will be shut down soon.

Better Business Bureau (although this is just a smokescreen)
U. S. Attorney General
State Attorney General

I know this is a lot but please do not give up. Your giving up is what is what Wilshire is banking on.

Remember there are hundreds of others in the same situation and we have to all support each other.

FIRST OF ALL I AM TRUELY SORRY YOU HAD SOME FINANCIAL DIFFICULTIES. I KNOW IT CAN BE VERY STRESSFULL. JUST TO LET YOU KNOW BY READING YOUR NOTES IT SOUNDS TO ME LIKE YOU MUST HAVE BEEN BEHIND MORE THAN JUST A FEW MONTHS AND I KNOW FOR A FACT AS A WILSHIRE EMPLOYEE THAT WORKS IN THE CALL CENTER THE ONLY TIME A PAYMENT WOULD BE DENIED IS IF THE CUSTOMER HAS SET UP MANY PAYMENT PLANS AND FAILED THEM ALL OR IS SEVERELY BEHIND, EVENTUALLY A LOCK WOULD BE PLACED ON ACCOUNT DUE TO FAILED PAYMENT PLAN AND WOULD HAVE TO HAVE MANAGERS APPROVAL FOR PAYMENT OR WILL REQUIRE TOTAL AMOUNT THAT IS PAST DUE TO BRING ACCOUNT CURRENT.

AND YOU PROBABLY WILL NOT SEE ANYONE STANDING OUTSIDE TAKING PICTURES CAUSE I AM PRETTY SURE YOU DON'T JUST STAND AT YOUR WINDOW 24-7 TO SEE IF SOMEONE IS PARKED ACROSS THE STREET TAKING PICTURES, AND WE DO HAVE A BROKER IN YOUR AREA DO AN APPRASIAL FOR WILSHIRE. AND YES YOU WILL INQUIRE COURT COST LEAGAL FEES DUE TO FORECLOSURE THAT IS WITH ANY COMPANY NOT JUST WILSHIRE.
