Another Ocwen Tale: We bought our house in Dec. 1998. The original mortgager went bankrupt and sold to a second company. The second company sold our mortgage to Ocwen within 9 months. It wasn't until Ocwen forced an insurance policy on us (claiming that we didn't have one) did we open a huge can of worms.
Ocwen did indeed pay our insurance policy, yet turned around and forced one on us. At that time, we realized that from the beginning of the mortgage, our payments did not include the escrow monies as stated in our closing documents.
Like an idiot, I entered into a forebearance agreement with them. I made each payment via Western Union (as instructed) including the $2900.00 fee they charged to enter the agreement. We then watched approximately $600 a month disappear into an escrow account that never went into the black. The more money we gave them, the more money we owed. They even sent us their own general ledger and money is disbursed into "suspense" accounts or just falls off the page.
At the end of 1 year in forebearance, we still owed (according to Ocwen) over $5000.00. During this time, Ocwen forced yet another insurance policy on us, after they paid our standing policy.
I called daily to ask what our payment would be at the end of forebearance and never could get an answer, as we were trying to refinance. I finally sent in our original truth in lending payment via Western Union.
They rejected it and have not accepted a payment since. Yes, I have an attorney (the second one for this mess). When we contacted Ms. Tina Scott of Codilis, she was more upset than my attorney. She said she'd get back to us and we went 18 months with no contact. She left the firm somewhere in that time. And then the fun started again.
Every month we have a foreclosure notice. Every month we get a minimum of 25 letters from (vulture) attorneys and real estate folks claiming they can help. We've had people knock on our door, walk through our back yard to look in windows, take pictures of the house and even received 3 $5000.00 checks from people wanting to buy our house out from under us.
The first Tuesday of each month, we wait to see if we will be foreclosed on. We are desperately looking for others, especially in Texas, who are going through or who have gone through this same hell with Ocwen.
My attorney says we live in one of the most conservative counties for foreclosure, yet I don't trust it.
For anyone that is going through this, hang in there. Keep the faith. If it takes filing bankrupcy to win this, we will. It's not like we can buy a car, get a loan or a credit card for what they've done to us. I'm not even sure we could refinance at this point. Living the American dream with Ocwen is pure hell.

#1 Consumer Suggestion
Believe it!

Suzi, believe it cause I never thought it would happen to me either. I was just foreclosed on this past March 2003. And this was even after I declared bankruptcy.
Don't rely on the "conservatism" of your state. I was told by many government agencies AND my attorney to hang in there too. Now my family and me are homeless and I owned my home for 17 3/4 years.
Now my only hope for any help is the class action lawsuit that Mr. Hanson has with Ocwen, thanks to this site. Send your story signed and notarized to:
