Sears Marketplace Merchant Red Tag Online Bought MAC lipstick from Sears Merchant and received counterfeit item Internet

I purchased a MAC Riveting Rose lipstick from Redtagonline on November 19, 2013. Redtagonline is a store in the Sears marketplace. The lipstick I was sent is a fake one. The lipstick was in a different container, the sticker on the bottom was wrong, the lipstick had no scent like a true MAC lipstick, and it was the wrong color.

I contacted Sears 5 times in reference to the counterfeit item and they would not help me. They sent emails to the company but they never attempted to contact me. I told the Sears customer service agent every time that the item was a fake. All they did was email the company stating I wanted a refund. Redtagonline responded after the third attempt and stated I could not do a return if the item is opened or used. I wouldn't have known it was a fake without opening the box. I did not use the item. I used Paypal to pay for the item and was refunded by Paypal. They are allowing the seller to still sell fake items. I do not want someone else to get duped by purchasing an item from Sears.

I opened a case with the Better Business Bureau about the issue. Sears replied stating all returns of products sold and fulfilled by a third-party merchant, including damaged and incorrect products, must be returned directly to such third-party merchant. They said they take my comments concerning this vendor very seriously, they have forwarded my complaint to their corporate office that is in charge of their vendor department so that they may investigate the claims that were made in my complaint. For my "inconvenience" in this matter, Sears processed a $10.00 egift card. They said they have addressed my complaint and respectfully request this case be closed. The merchant is still selling items on the Sears marketplace which is the reason I opened a case in the first case. Case not closed.
