I purchased a Pontiac Grand-AM through a local finance company in the Cincinnati area in 1998 for $7900 with finance charges over 36 months totaling $10500. Three months after paying on the loan, the company told me they are going out of business and someone will contact me with the new payment arrangement. Several months passed, and with me trying all numbers and addresses that was known to contact the new "Lein Holder" to no avail. I received notice from SEAWEST FINANCIAL that they are the new company I will be paying the balance of the loan. I asked if the original loan agreement was the same,which included an extended 18 months warranty on the vehicle and they said "everything is the same, only the name and location has changed" so i then continued making all my payments including a lumpsum of $1500.which was passed due, during the time when i did'nt hear from anyone. This went on for about a year with no problems until it was time to honor the warranty agreenment to fix the car, then the drama started, whenever i call, i would be put on hold, be transfered to a couple different departments, the standard runaround, after several attempts i was told by one of their employees to go ahead fix the car and send them the bill, and then in turn my monthly payments will be reduced in accordance with the bill, so thats what i did, but my bill still stay the same, never received any refund for the repairs on several ocassions i called to find out what was going on and again the runaround, all this time im still making my payments on time. Eventually the car was costing too much so i decided to trade it in, this is under 3 years, thinking i only had 3 months payment left, i went to a car dealership for the trade, when they call for the payoff, i was told i owe too much and the trade will be impossible. I was told i still owe $7900,thats after 33 months payments on a 36 month contract. When i asked them to send me a copy of the Financial agreement, they did, but it was not the same agreement i sign, it was completly different,so after i tried to get it rectified which went on and on for months, they told me bottom line i still owe $7900, by then the car was dead, could'nt be driven, i told them i'm not paying another dime, because by then the car was already paid off in accordance to the origional contract, i told them i want my title, and to come get their garbage from my driveway, that was the last i heard from them (2001). Recently i applied for a home loan, and on my credit report it shows in 3 different location that i owe over $10000. to SEAWEST and another company, CPS, but what's worst of all, they have been to court and was granted a judgement for that amount. I was never invited, call, requested or summoned to court for any hearing, so how is that possible? Now my credit is screwed because of SEAWEST and their greed, what am i supposed to do? is there anyone out there that can put a stop to these criminals, someone please help me!

Has anyone out there ever taken seawest to court and won their case or had any judgement against them ??? Can you give me some info..details anything ..

You will need a lawyer to do this, but you need to petition the court for a stay of judgement.
Explain that you satisfied the contract, and that you were never served or notified in any way of this action against you.
SeaWest Financial probably fabricated documents and got a summary judgement.
When you dispute this to the credit bureaus, specify that you want to see a copy of the judgement. Then you contact the court and request to see proof of service on it. Chances are good it was falsified.
You have a good lawsuit here if you have good documentation.
