I sit here and cry reading all of your reports. I feel like my young family is going to be out of our home. I called them today, to make our "late" payment..I owe for July and now August has come due. My "representative" refused to take my payment, stating, "I will take your payment only when you can make them both at one time. You have until the 18th of this month, otherwise we will drop your loan." How am I in default?
I tried to make one payment, the ONE payment that I could afford, and she absolutely refused it! Now I admit that we have supposedly been default according to their records. We don't even have a contract with this company...never signed anything. They bought our loan from Oakwood.
We, just like all of you have described, have had very similar problems with our "brand new" home. My laundry room floor is literally falling in from our a/c breaking 3 years in a row. There are nasty black water marks coming down our walls in every room of our house. Each time they say we have to call our insurance company.
Then today, the woman even stated we didn't have insurance, which we do. She began yelling at me, telling me how sorry I was because I didn't work to help out my husband. Yes, I could work, but who can afford childcare? My husband has recently started his own business and we're struggling to make ALL of our bills...not just to them. We've had our phone turned off, our lights turned off, car insurance lapse, car problems...you name it.
My husband works HARD...EVERY DAY! Sometimes even up to 18 hours a day. We send out invoices, then we have to sit back and wait to be paid, just like them. I always get, "DO you think you'll EVER know when we'll see another payment?!" THey get paid, just not exactly on time each time and I know it's not their fault, but lately they've been lying to us about alot of things, like us not having insurance. I made a payment last week, then tried again today, and she really did refuse it.
I thought there was some type of law that if you are attempting to make a payment, there is only little they can do. But she blatently told me, "Here, I'm gonna record this...Mrs. #$#, you are refusing to make your payment." I butted in, "NO! YOU are REFUSING to ACCEPT my payment!" She hung up on me and now keeps disconnecting my calls.
I don't know what to do. We are young and we have 2 kids of our own and raising my older sister's. He works hard, but really needs me at home for the so called office duties. I can't get a job, but they can't get away with treating people like this, CAN THEY???!!! I would also like to join this class action lawsuit you all speak of. These people are hateful. But be weary of their "in-house" lawyer!! (I'm scared....NOT!)

Today, I got another letter in the mail stating they didn't have my insurance information. I also got one last week. Well, when I first got the letter last week, I called my insurance company and requested them to FAX my ENTIRE policy to Vanderbilt. I called them back today and the insurance company said they had indeed faxed it, so I had to call Vanderbilt. I couldn't believe what happened!! THe lady ACTUALLY went through the faxes and found it. When she came back to the phone, she said my account was fine. I HOPE this is all. If anything else comes of it, I'll let you all know. But the case still isn't closed all together....

Kelly, does Vanderbilt have you monitoring this website now? Amazing, you can't tell me that they weren't aware that their reputation was bad. You can go back to Warren Buffet and tell him to go to h***. Give Bill Gates another billion, he's getting it from all these people out here, the people he's trying to throw out of their homes. I've told the State of Tennessee about this website, h*** I sent them a stack two inches thick so they could look at all the complaints. I'm only sorry that you will be out of a job when we all band together and take their Vanderbilt's A** to court and nail them to the wall. I'm waiting for the day to celebrate.

After I brought my payments to current, I was told they were adding insurance on next months payment. I told them I had insurance and he politely asked me to get in touch with my insurance company and get them to send proof. I did just as he asked, as well as having them to send me a COMPLETE policy copy to myself. It DOES IN FACT state on my policy, that I AM CURRENT, with NO LAPSE IN COVERAGE. I will let all of you know what happens next.

Unfortunately mortgage companies can refuse what they consider a partial payment. Even if you dispute say an insurance payment; if you try to only pay the mortgage payment and not pay the insurance payment; they can refuse to accept it. Vanderbilt doesn't care about your circumstances they only care about one thing..... getting your money. I have been treated rudely by these people before; I just let them rant and I continue to be nice or I just keep my mouth shut. They are like children on a playground, once they see they can't rile or upset you its no fun anymore. I make my payments online now so I don't have to talk to them.

I also failed to mention that our payments are a whopping $814/mth for our 24x70 with 3 acres....IN THE COUNTRY! I WISH we were only paying $600/mtn.
