In 2023, I used Fairway Independent Mortgage Corporation to finance my first home with an FHA loan. My loan officer, Alisa Bailey, referred me to a real estate agent who later omitted a signed repair amendment from the closing documents.
The home had multiple safety issues, including ungrounded outlets and leaking plumbing. Repairs were contractually agreed to, but after closing I discovered the amendment wasn’t included in the paperwork. The document was added weeks later, after it was too late to enforce.
Fairway submitted a HUD addendum that appeared compliant but was actually signed by me on a different date. This violates HUD rules that require it to be signed at or before closing. Their own response to the CFPB confirmed the timeline, yet no action was taken.
Due to the false claims about the home’s condition and the improper documentation, I moved into an unsafe home. I had to pay over $37,000 out-of-pocket to make it livable. My insurance paid an additional $13,720, and I was left in hardship during and after pregnancy.
I suffered a bone infection, worsening depression, and had to raise my newborn in unsafe conditions. Fairway never followed up on my reports, despite stating they were investigating. I sent multiple follow-ups and received no resolution.
The Texas Real Estate Commission formally disciplined the agent Fairway referred me to (TREC File #245859), confirming that serious errors were made. Fairway has refused to acknowledge any role in the damage that followed.
Shortly after closing, Fairway sold my loan to another company—severing ties and avoiding responsibility for the issues I faced. If you’re relying on Fairway to protect your loan and your interests, be cautious. My experience involved misrepresentation, document discrepancies, and long-term harm to me and my child. No one has been held accountable.

Oh, let me guess.... you paid six figures or so for this place and you didn't even have YOUR OWN attorney to advise you during the process? How many papers did you sign at Closing? Did you READ and UNDERSTAND every one of them BEFORE you signed? Guess what Einstein, if you would have had YOUR ATTORNEY representing you from the start, YOUR ATTORNEY wiuld have prevented this from happening! Whatvabout YOUR HOME INSPECTOR? What did the repirt say when you read it BEFORE you agreed to buy? I bet you didnt even have an inspector of your own, did you? Since you are clearly not skilled in such purchases and/or you have little to no COMMON SENSE, you can also throw away the stupid, talk radio conspiracy garbage too. Loans are bought and sold every business day and in every state. The selling of loans is COMMON PLACE and you have no say in the matter since you don't own the loan, the lender does and nobody was out to get you or hide anything from you! BOTTOM LINE: This happened because YOU had no legal representation to protect you. Buying or selling real estate isn't amateur night.
