Back in January of 2021, my daughter passed away unexpectedly at the age of 23. She apparently had an auto insurance policy with USAA and had used my address for her correspondence even though she was not living with me. After she passed, I joined in with the rest of the family to make sure her creditors were aware of her death; making phone calls and sending out the death certificate when asked. Since the first past due notice came to me (first ever I knew she had insurance with USAA) I called customer support and let them know. They passed me along to their Survivor Services who asked me to send in a death certificate. At this point, everyone was very sympathetic and handled the situation as you would expect. They assured me the account would be zeroed out and closed and I could ignore any correspondence from here on. Nearly two years later, I am still getting the reminder letters and the occasional bill addressed to the Executor of the Estate. There is no executor. She had no estate to speak of. This is the only entity that I know of that has asked for an executor. My initial inquiries with USAA were by phone and by Facebook Instant Messenger. Since my efforts to stop the letters have doubled down, they have apparently turned off my messages to them since none have been read since November 2021 and the last one resulted in phone calls to me from two of their suits in the office of the CEO who each told me that the letters cannot be stopped because of an IT issue with the old database. When I countered that that they could be stopped, they both disagreed and said they couldn't do anything about it. My only remedy is to have me or someone declare themselves executor through the court and they can then change the address for the letters - but the letters cannot be stopped. No money is due but the letters will continue! Now that I have exhausted two lawyers with this, I can state that although it is illegal to intentionally cause emotional distress, the courts see this as an unfavorable tort, based on 1st Amendment freedoms. In other words, it would be difficult for any court to rule in my favor. My second lawyer sent their CEO, Wayne Peacock, and his legal representative several letters but they either responded with excuses or just ignored them. I have also reached out to the Virginia State Corporation Commission, Bureau of Insurance but they simply responded by saying that I needed to declare myself as executor so I can change the address...to what????? The letters need to stop. This is not an isolated case as another friend of mine has been going through this longer than I have! This is why I am not letting this go. Returning to sender has not helped. Some have suggested a post office change of address back to their office but that will result in anything addressed to the executor to be sent there.
