On January 20, 2010, my son was driving my 2007 Toyota Yaris to school, when a driver insured by All State made an improper and reckless left turn and collided with my Yaris, which ended up being declared total loss according to All State own adjuster.  All Sate had my car towed and promised to pay me 75% the market value of the car as they assumed that my son was 25% responsible for the accident.  I returned the check representing 75% back to All State, and All Sate was later found unable to prove any liability against me, and they admitted so before Arbitration Forums (docket # A025-11357-11-00) on 11/9/2011.  

With that said, All State should have sent me the check representing 100% right after they admitted before Arbitration Forums that they were the proximate cause of the loss.  However, All State has not paid me a dime still, and that more than four years later.  I spent so much money on transportation for my son to attend FIU until he gradutated.  I have spent several grands on lawyers and court fees, but the court system in Miami decided, without ever hearing my case, took the side of All State instead of allowing justice to prevail.    

I still have the original title for the car in my possession as, according to Florida law, I could not have given the title to All State since they have not paid me yet.  I have undergone a lot of emotional and physical distress during those long years.  The day before yesterday, I decided to look through the internet.  Now that I am writing this, I am still in chock.....I can't believe what I have found.  All State, in complicity with Capital One Auto Finance, and apparently in complicity with a representative at the Florida Department of Highway and Motor Vehicles level, has managed to FALSIFY documents (as if the car that I bought cash actually had a lien from Capital One Auto Finance) to obtain a title issued on 1/15/2013 to expire on 1/5/2015, as a way to probably salvage my car and make it disappear from the record.  And, that, without ever paying me for a car I bought cash with my sweat and hard work.  

I think this is obsurd, cynical....I cannot believe for a big corporation like All State to be allowed to rob and inflict me so much pain, distress and monetary loss, and be led to go with it. I think that I am being robbed by everyone who supposedly are responsible for making justice prevail, and I wonder whether my very constitutional right is not being violated. That's a shame on the Dpt of Highway and Motor Vehicles in Florida, it degrades authorities in Florida, and it is a disgrace from everyone compliciting in order for AllState to rob me, insult my intelligence and mislead me altogether.  Indeed, I believe I am being treated by everyone involved as a second-class citizen, while laws and statues in Florida with regard to totaled cars clearly indicate what should have been done and that I should have received my check about 45 days after the car was declared totaled.
