For many years I cared for my terminally ill husband. There was no one to help with any outside repairs to our house. In 2010 I lost my husband, but at that time my Mother had a massive stroke and I was caring for her in my home. I lost her right before Christmas of 2010. I found myself, at an age one doesn't expect to find themselves, a widow and an orphan, and a house in serious need of repairs I couldn't do nor did I have the funds to finance these repairs.

Around this same time, a family of raccoons invaded my attic, so I called "

ALLSTATE", my insurance company who ran their great commercial about mayhem and raccoons in the attic, so relieved my insurance company would help me. I spoke with my agent, Joe Williams, he told me I had to get rid of the raccoons before they could file a claim for me. He also said he couldn't remember if ALLSTATE paid for the removal, or the clean-up, but it was 'one or the other, and he gave me an 800 number to file a claim when I had the raccoons gone. This took a lot of time, with asking for help in relocating the raccoons after catching them in a live trap which isn't as easy as it sounds.

Not long after I learned of Joe Williams retirement, and a few months later I called my new

allstate agent, Steven Mescall and told him of the situation, and that I had spoken to Joe Williams previously. Mr. Mescall told me to just let him know when the raccoons were gone and he would file the claim for me. Not long after, last November, I got a notice in the mail that an inspector from allstate would be by to access my house for insurance purposes. When he did, I received a letter informing me of al the repairs that needed to be made including pictures of these repairs.

I then contacted my agent, Steven Mescall and he had also received a copy of the letter and the pictures. In reviewing the pictures Mr. Mescall told me that the damage done by the raccoons, which was most of the damage, would be covered by the claim so I didn't worry a lot about it and due to a hard, nasty and very cold winter I couldn't get anything, even minor, done on my house.

While I had borrowed the live trap and did my best to capture and remove a number of raccoons, this evidently took more time than my ONLY insurance company of over 30 years felt I needed and in the end denied my claim, even though at no time did either of Allstate's agents tell me I was on a time limit.

The raccoons had destroyed some of the soffit, facia, a portion of roof, insulation and siding. Adding insult to injury, my insurance company sent out an appraiser who advised me if I did not get the repairs taken care of they would drop me at the end of May, 2013. Today I received a letter informing me Allstate had dropped me.

Unfortunately, I am also paying an exorbitant amount for electricity which is what heats my homes. My last three electric bills were almost $500.00 each, prohibiting me from saving any money to have the repairs done or the insulation replaced. My house is large, it held a big family once, now it's just me, and while I only heat three rooms in my house, it's is more than I can afford. I live solely on social security, and even though it's not much, it puts me just above the poverty level.

The total cost of the repairs would come to maybe $5,000 to $7,000, and with only one claim for roof damage done by hail in 1994, they have decided I am no longer worthy of their claim that I am in Good Hands.

I am at my wits end with no idea of what to do.

You still have a valid claim even after the policy has expired or been non -renewed. However, under Indiana Satue regardless if the policy says you have one year to file a claim or suit, you actually have 2 years from the date fo loss to file your claim with Proof of Loss. It sounds like your claim was not properly filed. Dont rely on your agent , its not their job to file your claim, they sell the policy. They are not claim experts. They promise you the house, garae and throw in the kitchen sink to get your premiums, but not all losses are covered even though they may say your fully covered. Dont believe it!

The adjuster for Allstate does not share your interest, the adjuster job is to pay what they cannot deny. ITS YOUR DUTY TO FILE THE PROPER CLAIM AS REQUIRED UNDER THE CONTRACT, NOT THEIRS. They work for the insurer, not you. What you say to them will and can be used agaisnt your claim in many instances. 

The claim issue shave several conditions that must be followed and your agent as with most agents have little ot no training in claim adjusting. They do not get paid or have authority to adjust your claim. Agents generally give out bad advise out of inexperience and are told by most carriers not to get involved in the claim process. There are hundreds of  nuanaces involved in every claim. 

If you have coverage for damage by animals which most polciies exclude, then they have triggered coverage and now it becomes a loss for damages under the terms of the policy which is specific. The time lines are important , did they ask or demad a Proof Of Loss form you? did they give you a POL form to file?  Late reporting issues will need to be over come along with many other issues, but it appears you have a vlaid claim that has been wrongly declined, most likley due to a lack of proper filing of the suport loss, damages and proof of loss filing timely. The resulting damages outside the actual raccon damage is also to be considered in your claim. 

You should consider hiring an Indiana claim advocate or an Indiana public adjuster in your State to help you Navigate the Claim Maze. It may cost you 20% but you are at zero dollars now, so you can get 80% of your claim paid with help. If you had to  argue with IRS over taxes, would you not hire an CPA?  Here, an experinced public adjuster representing your interest is worth the money. If they do not make a recovery they do not vharge you a fee for their services. In essence if they do not win, you owe them nothing. Its a win-win for you.
