America's Servicing Company (ASC) Charged a $75 late charge to my September bill when my bank has documentd the delivery dat of the payment to be the 14th of September. Late fees may only be charged after the 16th of the month. Des Moines Iowa

I am writing to record my experience with America's Servicing Company ASC, the mortgage company who bought my mortgage in 2006. I made my first payment in June and noticed on my bill pay screen at Bank of America's on line banking site, that if I entered a payment on the 1st of the month the delivery date would be 7 days later. This concerned me, it does not take 7 days to deliver a bill from NJ to Maryland.

On September 7, 2006 I sent a mortgage payment ASC using Bank of America's online bill pay. As I described the delivery date was recorded as September 14, 2006. I noted this at the time and was satisfied that it would not be considered a late payment.

On September 26,2006 I recieved a letter from ASC stating that I
was being charged $75 in late fees for the September payment. I printed out my documentation from Bank of America showing proof that this payment was delivered to ASC on September 14 and began attempting to comtact ASC.

Their monthly statements do not relfect their physical location, only post office boxes. Their website is very nebulous with access to login but no access to register to login.

Their description on their website is: "America's Servicing Company, better known as ASC, a division of a well-known and respected mortgage company, is the subservicing/contract servicing operation. Loans may be serviced under the name of the client or ASC." I find this verbage concerning and secretive. May I please know the name of this well known and respected company to whom I owe a quarter of a milllion dollars??

Now thoroughly alarmed I google ASC and find many results with responses from customers with multiple complaints in all various states of distress. There are complaints related to flood insurance and erroneous late payment fees. I am documenting all
communications and their responses and am seeking legal advice on my rights before I become the next victim of this mortgage predator. I will update here.
