I am writing you this letter for a transaction dispute in the amount of $395 which occurred on December 10, 2007 with Amerisave. This company required a good faith deposit in the amount of $395. Do not give them your credit card number!!

I never gave legal consent to make this transaction. This transaction requires a legally binding document/contract/application to be signed for which they specifically provide and which never occurred on my part. There is a legal written document called a Credit Card Authorization For Application Deposit which must first be signed to authorize this transaction.

They will charge your credit card anyway and you will have to fight to get the funds credited back to your account. Do not do business with them!!

As well once they forward the documentation and fees, everything will have changed from what they originally quoted you. This is a corrupt company which could be alleged as fraud. Please consult all media, Better Business Bureau, Consumer Protection Agencies for both the state and county, Federal Reserve, Credit Card Companies (Dispute Departments), Banking Industry and your attorney to submit appropriate complaints.

They will also lead you on to expect returned phone calls and promises that your deposit will be refunded in which case never occurs. Move forward with all complaints right away as to bring this kind of action to a halt. Class action lawsuits can also be a consideration since so many people are having the same issues.

Report this company to any public government agency and related entities in the private sector. Do not let them get away with this!!

Maybe if anyone ever returned any calls then people would be able to talk to management! No one returns calls or emails and all you get is a HUGE RUNAROUND!!!

Amerisave's deposit policy is clearly stated at the time of deposit, and it is not unlike most companies' policy in the industry.

The policy states:


The borrower(s) acknowledge that Amerisave accepts loan applications and issues conditional loan approvals based on the information provided on the customer's application. In consideration of Amerisave accepting this loan application, and to begin processing the loan, Amerisave requires an application deposit of $395.00 at the time we lock in your rate. This deposit will be applied towards borrower's total closing costs/charges during the processing of your loan and is not an additional fee. By requesting a rate lock, borrower(s) acknowledges that the application must be conditionally approved before Amerisave can lock the rate selected. Rates are subject to change based on market conditions. In the event that Amerisave is unable to lock in the requested rate for any reason, Amerisave will not charge the Borrower or the Co-Borrower the application deposit of $395.00.

After we have locked your interest rate and registered your loan, should you choose to cancel your application the deposit is non-refundable unless required by law. If your loan is declined for reasons such as income verification, appraisal issues or other factors not considered in the pre-approval process, the balance of the deposit is refundable after third party charges have been paid.


Amerisave obtains authorization from the borrower to charge a credit card when the card number is input during the application. It is clear in the process that the credit card will be charged. During the Amerisave application the borrower must check a box that states:

I authorize Amerisave to charge my credit card $395

No card number is taken unless this box is checked. Additionally, Amerisave sends an authorization form for the borrower to sign and send back with the other loan documents to confirm the deposit charge.

If you feel you were charged in error and deserve a refund, please ask your loan advisor to speak to his or her manager.

Follow these steps if you have problems with Amerisave!!!

Please follow these steps to resolve problems at Amerisave:


1. Contact the Banking department of your state where they have licence to operate, you can find this online.

2. Report them with the better business bureau at bbb.org

3. Send a letter to their CEO and avoid the Directors and Bankers. Go above their heads right to Client relations or the CEO and tell them you were lied to

4. Threaten to take them to a small claims court.

5. Contact your state attorney generals office and file a complaint, just google 'attorney general state of Georga and you can complete the complaint on line.

6. Call your credit card company and dipute the charge.

7. Demand them to listen to the call clip -- ALL CALLS are recorded

8. I would personally email Tom Walsh from the local Detroit paper.

9. Complain to local tv stations and consumer protection agencies for the state and county.

10. Demand to see the invoice from the appraiser and demand the difference back. And do NOT pay for any QLSS or any other junk fee. Call the appraiser direct and ask for a copy of the invoice.

11. Tell your friends and family not to do business with them.

12. All of this will not cost you a penny and in most cases you will get your money fully refunded.

13. Contact the Federal Trade Commissiion FTC.GOV and file a complaint online.

14. Contact the Housing Discrimination Act online and file a complaint.

15. Contact the FBI and submit a complaint for investigation.

16. Other contact options are the governor and media/city newspapers/editorial.
