Bally Total Fitness Won't provide refund; Call center employees keep giving different refund amounts and dates when inquiring. Fresno California

After relocating in June to an area without a Bally's location nearby, I canceled my membership. Shortly after my cancellation, I received a letter in the mail informing me that I would be receiving my refund by September 11 2008. About a week later, I received a check in the mail from Bally's for $1.00 which is drastically less than the amount the initial letter said I would receive.

When I contacted Bally's to inquire about the measly $1.00 check, the employee I was speaking to told me that the rest of my refund had been processed in their system and that I should receive it by the date printed on the letter I had received. I should mention that the recording on their automated system said I would receive one amount, the letter said another, and the employee something entirely different.

On September 13th I called, yet again, because I had not received my refund yet. Again, the automated system said one amount, and when I FINALLY got an employee on the line, they said a different amount AGAIN. They then told me to wait longer and had no answer for me when I asked them how long I should wait before filing a lawsuit.

It has been six months since my membership was canceled and three months since the date printed on my refund confirmation letter, which is entirely too much waiting. I am disgusted with the way Bally's has been conducting business. They give you contradictory information to confuse you, and then tell you whatever you want to hear to stop your complaining.

All I wanted was the refund I am entitled to and have been promised in writing under their own company letterhead. The only exercise you will ever get from Bally's will be the stretching in your finances and maybe a raised heart-rate from having to deal with their incompetent staff.
