I signed up for a month to month plan (35 USD) at Bally Total Fitness in late Summer of 2007.

In April 2008 a really ugly incident happened at their location in West LA:
I was sitting in their sauna with a couple of other women when the cleaning lady showed up and started yelling at the woman sitting in the sauna (including myself). Standing in the opened door she started lecturing the women about the proper clothing for the sauna mentioning the manager would come if the dress code would not be respected..... she was very loud and annoying and also the entire heat was let out by her holding the door open.... I chose to leave.... to the showers.

It took about 10 seconds and the cleaning lady showed up again,.... this time yelling at me. Apparently she needed to clean the very shower I was in at the very moment. ... Well, standing naked under a shower and having someone yelling at you is quite disturbing and stressful. I had no choice other than to leave the shower in front of her eyes while she kept yelling at me,..... grabbing the towel and out of there.

I went straight to whoever was "in charge" at the time, since the manager was not present. Crying and upset. Asking for an immediate cancellation of my contract. This was apparently not possible. I tried it twice over the phone and multiple times over the internet. I even send a very long hand-written letter.

I have received one email in response to one of the emails... apparently the cancellation had been accepted.....

Happy ending? I went off to Germany for a few months .... unable to keep track of my US-bank-account (for security reasons the bank had changed my debit-card number).... and now.... being returned... finding that Bally kept charging the account 35 USD for May, June and July (total: 105 USD). The charges had only stopped due to the bank's security procedure. (... Lucky me... I am a foreigner that was never given a credit history.)

I emailed them again and they agreed to reimburse me for 45USD. Apparently there is now an early cancellation fee of 25 USD on this month-to-month contract of mine. This cancellation fee was not in the contract of mine.

I am still waiting for an apology regarding that incident in April. Also I believe the continuation of charges after a cancellation has been accepted can not be right. ... why is the early cancellation-fee mentioned for the first time 7 months after the cancellation has been approved?????
