I have ammassed over $4000 dollars in NSF fees with BOA within the last year. Having been a customer for over 2 years without any returned checks, my family fell on hard times. Scruitining our online statements revealed that I was being chaged NSF fees, for pending items, which even occurred at midnight , the same day my Direct Deposit was placed into my account.

Also funds that were placed on a 10 day hold, (which i was not informed would be placed on hold) PayCheck from a fortune 500 company, were released to Bank of America in 3 days, however were not credited to my account and incurred addtional NSF Fees.

I have never sued or taken part in a lawsuit, however this has been very well documented and I would welcome the opprotunity.

I have only listed one or 2 examples but there quite a long list.

Debit/Pin# Purchase vs Credit Card Type Purchase

That's the key. If you swipe your card as a debit and input your pin #, that transaction posts IMMEDIATELY to the ledger, even though you will not see this updated immediately in the online ledger. Because this transaction posts IMMEDIATELY, this is why it posts before any deposits. Because the deposits are not posted until the nightly processing begins like ALL OTHER transactions. Debit/Pin purchases post IMMEDIATELY to the ledger, the VERY SECOND they're made. But you will not see this online because BofA doesn't update its online ledger for REAL TIME posts like OTHER banks do.

On the other hand, if you swipe your card as a Credit Card and sign the receipt, this transaction DOES NOT post immediately to the ledger. It will not post until the Merchant sends it in. And when the Merchant does send it in for payment, this Credit Card type transaction will post in it's proper place, just like all other transactions during nightly procesing. This means it will post AFTER any deposits being credited for that night because BofA posts Deposits first.

First of all, there is NO RIP OFF HERE. Only another uneducated consumer who fails to use a checkbook register.

If you do not maintain an ACCURATE checkbook register, you WILL pay NSF fees. Guaranteed. You CANNOT rely on online banking or ATM's to determine your available balance.

FYI..At almost all banks, checks/charges are posted BEFORE deposits/credits in the same business day. This means that if you made a debit card transaction the night before your direct deposit, you have overdrafted your account according to the funds availability policy in your terms and conditions agreement.

Funds MUST be POSTED and AVAILABLE in your account PRIOR to making a debit card transaction or writing a check. The days of floating transactions are long gone.

Get some education on how things work, and maintain an ACCURATE checkbook register, and your problems will go away.

"Scruitining our online statements"

Why weren't you scrutinizing your own register? Yeah, that pesky thing that would have saved you four grand. The 10 day holds are for being habitually overdrawing your account. Who cares what company it comes from. YOU overspend your account continuosly. If your family is really on hard times, a lot more effort by you alone on keeping track of your finances and what you spend is needed.

It is truly an obscene amount of money to have to pay. However, the bank's actions are legal. I assume that the list of fees was somewhere in the new account packet and it's not unusual for banks to place a hold on checks deposited in an account with a large number of overdrafts.
