Bank of America is a sloppy bank and no one should use them! I recently deposited a check into my account in the amount of $2,500. The check CLEARED in my account the next day and the funds were listed as AVAILABLE.

Based on that info, I immediately began writing checks for bills and made purchases with my debit card. It was not until a whole 5 DAYS LATER did BOA do their homework to find out if the check was actually good. Not only did they NOT notify me, but they also removed all the funds from my account, placing my account in the negative.

When I contacted BOA, they made it out to be my fault and basically said there was nothing that they could do about the $1990 worth of checks that I had just written against the money that was supposedly now not available anymore! Furthermore, my account then reflected a negative balance and I would incur overdraft fees. The rep went on to say that it would be my responsibility to take up this matter with my local bank in regards to any overdraft fees incurred.

This is bad business! WHile it may be partially the fault of the person who wrote me a bad check, BOA is equally responsibe. They do not exercise good customer service!

I, too, have had problems with BofA

AUTHOR: Barbara - (U.S.A.)

POSTED: Thursday, December 08, 2005

Hello everyone,

To make a long story short, due to my ex-husband doing some shady things, my name is on "check systems" and BofA has been the only bank that has allowed me a checking account. (Please don't make suggestions about being on check systems, my situation is too long to type out and I know all about what to do, etc and that isn't the point of this topic).

With that said, I am about ready to give up my personal right to a checking account and close my BofA account because of their shady practices. I make a deposit and it will take an unusual amount of time to credit to my account, even case deposits bad in person at a branch. But they have no problem debiting my account of funds in a heartbeat.

Although I have called the "national" number and local branches and they say that what I see online for my account is exactly what they see also, activity and balances I see online is always vastly different from what they say they see and yet they won't work to help work things out to find out what is wrong.

Another words, they are never wrong. They are a bank. They are one of the largest banking systems in the world now (with all the recent mergers and layoffs), making all kinds of money off of their shady practices.

I would just try to get your account with BofA paid in full and withdraw your remaining balance and go to another bank. It just isn't worth arguing with them - they are always right and you don't have a clue (that's according to them!).

I am sorry you went through that mess. Just a tip with any bank, when you make such a large deposit, always call your bank, talk to a live person, and ask if those funds are truely available or if they are pending. It might help avoid such situations in the future.

I wish the best for you!

Available?

What do you mean when you say 'the funds were lsited as available'? It sounds like you are checking your balance online. If that is the case, that's why you got burned. BoA Online Banking lists your ledger balance, not your available balance.

A five-day turn around on a deposited check actually is pretty good, even more so if there is a weekend involved.

I hope you were able to recover from whoever gave you the check to begin with. If anyone needs some blame, it's them. As much as I'd enjoy bashing BoA, I can't see anything here to bash them for.

Listen up Erika, this was YOUR FAULT. I am not condoning any of BOA's practices, I think they are the worst bank in the world, BUT, they did you a favor by crediting the deposit to your account right away.

It was probably a local check written on a local bank, right? So they gave you provisional credit. Any bank would. However, if you had even the slightest doubt that the check wouldn't clear, you shouldn't have spent it! It isn't the bank's fault that the check was bad, therefor, they shouldn't have to refund you squat.

And, they are NOT equally responsible!! Get a grip. They are not mind-readers. They don't know if a check is good or not until it hits the originator's financial institution. NOW, if it was a BOA check that you deposited, then yes, you have a legitimate beef!
