I am 57 and recently suffered amajor heart attack, my business went bankrupt and i entered my resume on a major employment site. i recieved a reply from a out of the country firm that wanted my services on a weekly basis and willing to pay $1000 a week. I was suspicious but needed income badly the company sent me a check made out to me from a corporation.

i called the bank the check was written and they verified that it was a valid account but would not verify that the funds were available for the amount of the check $6800.00. I was instructed to deposit the check and wait till finds cleared and then make payments to their suppkiers via western union. Then I really got suspicious. But being broke, sick and unemployed I was desperate for income so I deposited the check.

I waited 2 days I called the local branch, I called the 800 number and asked these specific questions
1) are the funds available ANSWER yes
2) have the funds been collected ANSWER yes
3) is there any way the check can come back to me or bounce? I was assured by both people there was no way the money was collected and available. I then went into the bank and asked the teller the exact same questions as above and her answer was YES.

So I withdrew the money and sent it to where instructed less my salary and western union fees. Now 9 days later my account is in the minus my personalchecks are bouncing and all the bank can say is the deposit was returned. ANYONE HELP? do I have to pay this back? what are the legal ramifications to me? the money is gone I can't pay it back BANK OF AMERICA lied to me not once but 3 times now I am destitute

This is not the bank's fault. You fell for one of the classic scams out there in which some con man sends you a check, asks you to deposit the check, and then you wire money back to take care of taxes, fees, etc... The check they send you is almost impossible for Bank of America (or any bank out there) to discern its validity until they tell you it's no good. You can ask the company to send you another check - or better yet - ask them to wire you the money. My guess is that they will do neither.

Never let desperation get the better of your common sense. You may need to file for personal bankruptcy at this point based on your curent financial condition. I would speak to a BK attorney ASAP. Best of luck to you.

Charlie, I am sorry to read of all of the setbacks you have encountered. My best wishes for your health.

I am sorry to tell you that the people who sent you the check scammed you. It's a variation of the Nigerian scam. Look it up on your preferred search engine to learn more about it.

I'm afraid that you do have to pay this back. (I feel horrible writing this) As the owner of the account, the ultimate responsibility of your transactions falls to you. The bank will not allow itself to be left holding the bag.

As for legal ramifications, the bank will expect be paid back, as well as expecting any fees to be paid. There is the possibility that they will declare fraud. If the money isn't repaid, they will close the account and enter you into Chexsystems. The amount you owe will also go on your credit report.

I strongly advise you to talk to the bank and possibly a legal clinic. I can't promise what the bank will say, but if you explain the situation they may be willing to close the account and work with you on the fees.
