In 2008, there was a mortgage opened with Countrywide Bank. Money came out of an'accelerator' account[pays off mortgages in double time]. When discovered, cancelled that money from leaving acct. It was that new mortgage. Started asking questions and told bank[s] not my loan. Froze accts, closed credit cards, bank accts, reported ID theft, fraud alert and froze credit file. BOA either never investigated my claims or ignored them, becauuse bills continued. The bank INSISTED' it was mine and went to diff. branches, called diff. numbers, saw diff. employees, but no one didanything except continue to bill. Servicers harassed, bank bullied, and sent FEDEX mail 1-2x per week. Servicers, Fay and SETERUS, called ad nauseum-2-3x each day. Found out that my name wasn't on my deed for property, due to fraud, again.
At time mortgage taken against my property, someone put their name on it. I was wholly intimidated because the bank didn't do anything about this fraud. Never did not pay bills[credit 800+] and started paying, though still telling them not my debt. They sold loan in the end. When my daughter found out, she made complaints to CFPB, NYS Atty Gen'l. Banking Dept, District Atty, etc,... She discovered all this info in 2017 when they started foreclosure on my home that was free and clear before. Asked for modification in 2015, they recorded it as mortgage and consolidation, as if to legitimize that bad loan.New mortgage and what was there to consolidate! FANNIE MAE backed docs said 'modif. agreement' not new mortgage in NYC, but they are named plaintiff in foreclosure case, even after didn't keep 3 trial pmt condition. Agreement and guidelines said if conditions not kept, agreement void and reverts back to original loan[holder]-BOA. BOA responded to CFPB complaints with atty;law firm in 2018. 2months later they sent affidavit for fraud-officially?
10 years later and after sold loan. BOA should have known better than doing the same things that they were in trouble for already. Im retired, on fixed income and unable to pay anymore for someone else's debt. WILL NOT pay. Besides, my name wasnt on my property when loan taken out, and what bank would give a 200k+ mortgage to someone without a property as security and guarantee of repayment...unless there was fraud involved, on either their behalf or someone else? Got docs, tax returns, the recorded mortgage and the recorded deed[fraudulent], atty. letter, and even have the name of the'alleged' criminal who perpetrated fraud on my identity and my property[ies]. Have so much 'public' information that the bank could have accessed without much effort, and now in court trying to prove not mine and getting the attys to prove it is. Certainly they cannot. What else do I need? BOA has been taking my money for years and as a long time customer, it is unbelievable the lengths they would go to maintain and misrepresent fraudulent mortgage. They will even try to take it away, before conceding fault, wrongdoing and exercise ethics in banking.
