I have had a couple of issues with a banking giant that is supposed to serve the public. First they pull this unethical practice of overdrafting scam. Second they pay their top executives vast amounts of "bonuses" for creating such huge profits for their company and shareholders, despite the fact that they are asking for government help to bail them out after questionable mortgage "deals".

I to have been a victim of their so called overdraft scam. I would aproximate they took me for some $500 in overdraft fees because of alleged insufficient funds in my account, which is not true. Like many of you out there I checked my account balance at a local A.T.M. which showed sufficient funds just to receive a notice by mail a couple of weeks later stating that I had overdrafted my account. And like many of you they charged the largest to smallest dollar amount, not by order of transaction.

What makes the matter worse is that I work part time as a courier and attend college as well. I also receive funding from my government G.I. Bill, which is in the amount of aproximately $1,300. I receive this amount on a monthly basis. It is my believe that they used this information to set me up for failure. They figured "here is this stupid veteran getting government money, lets take our cut". I realize this is totaly based on my opinion, but what other explanation is there.

Another point I would like to make is that currently there is a class action lawsuit against B of A in the state of California that goes in front of the California Supreme Court in May of 2009 if I am not mistaken. The problem with that is that the lawsuit has most of the money going to the lawyers and a maximum $78 to the customers themselves. If this is justice count me out. I beleive B of A should pay each customer what they rightfully deserve and stick them with all legal fees. On top of that each customer should be payed for pain and suffering, considering the current economic situation.

To long has corporate america gotten away with stealing from the American public and hiding behind the legal mumbo-jumbo they can concoct to confuse their own customers. Let me close by adding one important question, "Where the #@!$ is my bailout!!!"

I love your posts...you and I are totally on the same wave length...wouldn't it be great if people actually took responsibility for their own actions?? Oh wait, but then 90% of these reports would not be here for our amusement :)

- Yea and like many others have said this is an inaccurate way to manage your account. The ATM/On-Line/Phone banking only knows what has been submitted to them for processing by the merchant. If you have checks out that have not been received the bank has no way of knowing this. If you have debit card transactions that have not posted the bank has no way of knowing this. But once again..what does...YOUR Account Register. It is YOUR responsibility to write down every transaction you make, when you make them.

- No not like MANY of you, but ALL. This is how they process transactions and has always been the way. Yet again guess what..posting order does not matter IF you never overdraft your account.

- Believe me you are not that special. They do not have some person in some underground compound deciding to "mark" certain accounts. The simple fact is that you spent more than you had because you didn't keep an accurate register.

- Your right how could people not actually read the disclosures and figure out that spending more than they have in their account would actually result in them being charged OD Fees. No the fact is that they fail to take the time to read the disclosures, just as they refuse to take the time to manage their accounts.

Suggestions
1. Keep a Check Register, writing down every single transaction you make WHEN you make them.
2. Do not spend more than you have available in your account

If you refuse to do this then cut up the debit card(which I beleive most of your OD fees came from). Take out $20/$40/$60 what ever amount at one time and use that cash for your purchases. When you are out of cash you are out of money.
