Bank Of America Business Credit Card accessed my personal BofA account and withdrew aver $700.00 at once. Customer service claims that they can do that because it is stated in Terms and Conditions, which I asked to mail it to me 3 times and I still did not get it.
BofA Branch in west Covina saying that amount will not be refunded, even though they did not see and did not receive Terms and Conditions from Business Credit Card. I went to the Branch 3 times and Customer Service called Credit Card and asked for faxed copies of Terms and Conditions. BoA is a ripoff. Do not use this Bank. NOT SAFE. ANYONE CAN ACCESS YOUR ACCOUNT. THEY COMMINGLING MY MONEY.

This is a quote from the BofA business credit card terms and conditions (which I was able to pull up online in less than 15 seconds):
7) that on behalf of the Business entity and myself, I grant FIA Card Services a security interest and contractual right of offset in and to all deposit accounts now or hereafter maintained by the Business entity and/ or me with Bank of America or any of its affiliates to satisfy all liabilities incurred under the Business Card Agreement.

I have no doubt that with a small business credit card, that a personal guaranty was required or else the business is a dba.

When you got the Credit Card for your business did you sign a personal guarantee for it?
If so and it is delinquent it sounds like they were using the "Right to Offset". This is where they can take money from one account to "offset" the delinquency in another account at the same bank. This is a provision that EVERY financial institution has. It will not only be in the Credit Card terms but your Checking Account terms as well.
Now, if this "Business" account is in now way connected to your personal account then they have done a few illegal things.
So instead of trying to get the Terms and Conditions, because I can guarantee you that provision is there, you may want to start going after the actual credit agreement to see if you in fact did sign a personal guarantee or not.
