Beaverfloor Rip-off, Fraudulent, Thief, Yet Another Scam by Neal Martin, Why isn't this man in prison? Swanee Georgia

I am writing on behalf of my father, a 65 year-old man, who is currently being treated for Leukemia. He placed his order for hard-wood floors with Beaverfloor.com on August 29, 2003. Mr. Neal Martin, owner, promised the floors would be delivered to New York (where my dad resides) by September 15, 2003. My dad ordered the floors, because it was recommended that by removing the wall-to-wall carpeting in his home, would help reduce the risk of infection while under treatment. A check was mailed to Mr. Martin on September 2, 2003, and subsequently cashed on September 10, 2003, after being promisd by Martin that the check would be held in escrow until the order was shipped. BIG LIE!!!

Since September 15, 2003 (promised delivery date), my father has placed several telephone calls, wherein he is told Martin is either on the telephone, busy, etc., etc., and never returns the calls. At one time, Martin cancelled the order, and stated he would return my Dad's payment within 30 days, which was company policy, ANOTHER LIE!! Then he reinstated the order, and promised a delivery date of Oct. 15, 2003; again ANOTHER LIE. Finally, Dad cancelled the order, and was told he would receive his full refund of $2,850.00 within 30 days. YET, ANOTHER LIE!!!

A complaint has been filed with the Better Business Bureau in Atlanta, GA; the Governor's Office of Consumer Affairs, Atlanta, GA; the National Fraud Information Center; and the Attorney General's Office, Buffalo, NY. Additionally, my father has contacted Mr. Martin's accounting firm, FISHMAN & COMPANY, in Sandy Springs, GA, tele# 404-252-3773 - again, to no avail. First time called, he spoke "Tara", who informed my father, there were no monies in Beaverfloor's account (??), the second time, my dad was advised that they were paying bills from July on Mr. Martin's account (in October!!). This makes no sense!

After reading some of the complaints on this site, my question is this: why isn't this man in prison; and why is he still operating several different businesses, and continues stealing money from honest hard-working individuals?

Recently, my father was contacted by the Govenor's Office to inform that they have assigned an investigator, and that Mr. Martin, may be in violation of the elderly statue, which is enforced by the State of Georgia. He is expecting a telephone call tomorrow, Monday, with more information.
